Alright so I have ran into a confusing situation. I live in Indiana. I’ll explain what happened first
So one night I left the bar and was walking home by myself, I got arrested for public Intoxication under distrurbing the peace. I was put into an ambulance and taken to the hospital. I was being very mouthy with the police and making fun of them. They didn’t find it very funny. I had a knee brace on from an injury and they ended up cutting my jeans to remove the knee brace. They ended up slamming me into the wall and I injured my elbow. They took me to jail where I spent 3 hrs in solitary until my buddy bailed me out. They released me and at that point my bac. Was .18.
Now I’m not saying I was beaten, or the cops didn’t have a right to arrest me. They could have been trying to cuff me and I could have fell away. My memory of the events is not very good. Somehow in the hospital I managed to call my a friend who heard the incident and he said during the call I kept asking why they slammed me into the wall...very very unsure about what actually happened. Anyways I was being an idiot.
So things got weird afterwards, the police department will not tell me how I was disturbing the peace when I went in the next day to get a police report. I was not issued a court date. Nor did I leave with any paper work. I was arrested by campus police by the way. So two weeks went by and I didn’t receive anything. Then the school called and had to meet with them about it. I told them what I remembered and they said they would call the officer and get his side of the story and I would hear back from them in 48 hrs. I heard nothing. So I went to the hospital to get my paper work and they didn’t have anything on me which was very strange. Later I found out they used the wrong name on all my hospital forums. I have looked up my criminal record, checked for warrants, there’s nothing out there. This happened in September. I have not heard from anyone about anything at all.
How long should it take to file charges against me?
If they didn’t charge me with anything, why did I have to get bailed out ?
How do I figure out how I breached the peace?
Is it normal to release someone from jail when they are still highly intoxicated?
I’m very very confused by what has happened and it’s really bothering me that I haven’t gone to court yet. It seems like it would be a simple pi. It would make more sense to me if they said I was given a pi for being a danger to my self.

You should speak to a criminal defense attorney in your area. The attorney can get you the information you want.

And, if there are to be charges filed against you or if charges have already been filed, you will want this attorney to help you get out of whatever drunken mess you got yourself into.

How old are you?

Does your university/college have a legal clinic for students?

Seems very logical for you to come to that conclusion. I have posted one time on here, so for all you know I have drank one time in my life and have had 0 legal issues other than this. I was very hesitant in asking for help on a forum, because anytime you do, there’s always someone with low self esteem out there to try and put you down so they can have a better day. My question was about the legal procedures, I did not ask if anyone thought I needed to go to AA meetings. I’m sure after you read this you will also jump to the conclusion I need to go to anger management. I didn’t get on here blaming anyone, saying the cops set me up. I took responsibility for my mistake, most alcoholics don’t do that. So, I hope your life is amazing and you stay as perfect as you are, but please stay off my thread.
To the helpful poster. I’m 30 years old, I’m in a masters program so I don’t get all the perks of a full time student. But I’ll definitely check and see if I can go to the legal clinic. This whole situation has just seemed to be so weird to me

You are at a distinct disadvantage if/when charges are filed against you in that you remember very little of what happened the night you were arrested. This lends more strength to what the police say about the incident.

If your BAC was in fact .18 three hours after your arrest, your BAC was no doubt dangerously high at the time of your arrest. In many ways, it was probably fortunate you were stopped when you were, before you walked into traffic or choked on vomit.

Your attorney will look at the facts available to determine if the stop and arrest were conducted properly and if there could be some questions raised about the blood testing. All depends on what charges (if any) are filed against you.

Your attorney might want to check to see if there are any videos that show the incident.

And, whether you have a general alcohol problem or not, obviously you handled your alcohol consumption unwisely that night, for whatever reason. You might want to watch your drinking from here on out.

Good luck.

If that were the case, you would have said so instead of saying this.

Get help for your drinking...really.
If in fact there is a personal history of making poor decisions after drinking alcohol - whether these decisions have resulted in police involvement in the past or not - it can be smart from a defense perspective to seek alcohol counseling in advance of a court hearing. Judges tend to like it when defendants have recognized a problem and are actively trying to solve it.
