Arrested for violating terms of agreement

My son entered into an agreement with child support in New York and was keeping his terms of the agreement exactly as ordered. Yesterday, he was picked up for non payment. He Is able to produce every receipt and provide absolute proof that he did not violate the agreement. Has this happened to anybody else? Does he have any legal recourse since his rights very much seemed to have been violated?

What kind of receipts was he providing? Was he trying to pay with goods and services instead of cash? Was he trying to pay directly to the other parent instead of paying through the CSE? An arrest for non-payment of child support is normally the very last resort that a court uses. There are normally multiple steps that happen first.

IF your son was arrested he most definitely needs an attorney. He should start by speaking with whatever attorney represented him in his child support/divorce case.

The receipts for from money paid directly to child support providing proof that he had paid. He paid the court directly.

You need to be dealing with the arrest side of the problem now. The civil side and any suit for the violation of his rights, if there is one, will come later.

Well, your son would first have to convince a lawyer that his rights were violated to the extent that a worthwhile award was in play. It's not something I would count on.
