Apartment seached

Correct absolutely no knock I actually was watching my security camera video of my front door and it startled me as I didn't expect something like that. The apartment security guard went in front of the police and stuck the keys in and opened the door. Then the police went in front and started saying the usual "police" come talk to us. I released the chain and opened the door like 40% at that point in which they saw the ajax and just searched at that point. This I'm sure was a lie to enter the apartment as it was a large pile of ajax to be expensive hard drugs and the canister labeled ajax was next to it. Even if i consented it would have been after they used the keys to open the door which was illegal as far as i know. I moved and won't be moving back, especially to that apartment lol good business they do, 2.5 stars on yelp, so I don't care if anything is done within the department. If i had drugs i assume the fact that they illegally entered might dismiss it in court. However I'm sure people have tons of confidence in that law when they are found with hard drugs and go infront of a judge in an orange jump suit. Though you may never know. I don't think dead bodies would work with that one however :rolleyes:.

Thanks for the help I was pretty sure that was illegal trespassing on the apartment company's and the police's part. They actually caught me a few days before my lease was up and I moved like 100 miles away but still in California so I ended up not caring at all because I went to a much nicer place where I had ZERO problems with the police for 6 months to a year. Zero tickets I never even talked to a cop before I ended up moving out of state eventually. Shows you how crime can effect your wallet when your trying to earn rent from a property or your yelp/google review which everyone knows could practically put you out of business. Not to gross you out but the google photos of the property are people holding dust pans full of dead cockroaches and i'm talking like 20 of them in the photos if you want to know how it all goes in some places. Yea I didn't check those sites before i put down $1300 to $1500 a month for rent however I definitely found them in my apartment, the hallways, pool. Now I check yelp and google reviews and actually get good experiences. I actually found a cockroach more than a foot long and maybe a half a foot wide drinking the pool water once. Something to do with being close to Mexico but i was surprised i could find one of those you could put on a leash. The only bigger cockroaches were the police and security knocking at my door ;). I call it apartment hell because I've never had a worse experience with housing.

There was zero odor just the call about the mask. As I said they found zero drugs and ajax or bleach is the only smell that could have been in there. Also I do know they did something illegal because they used the apartment keys from security to open the door without leaving a couple days notice or having a warrant. Which is not legal. You have to post a notice on the door that your entering a few days prior or have a warrant or the other circumstances to use the keys they keep in apartment management to enter the apartment.
Quite frankly, you don't know what else contributed to the call unless you obtained a copy of the call recordings or CAD entry. What they told you at the scene may, or may NOT, have been the whole truth.

If they had probable cause to believe that there was a public health threat (drug lab, caustic chemicals, etc.), the law allows the authorities to make entry. Whether they had such cause, none of us know, and neither do you. As I mentioned, you can contact the agency and ask to speak to someone about the incident. But, as pointed out, the fact that it has been a year since it happened, even if the officers acted outside the scope of policy or the law there may be little that can be done.

I don't know I was wearing the mask throwing garbage in the dumpster and looked at two people in the hallway. 10 to 20 minutes later I received the police opening my door. What other evidence could have been obtained. I know if I threw the garbarge out without the mask on the police would not have been there. One of the two people probably saw me with the mask and called it a drug lab. I don't feel investigating much further matters a whole bunch. Im pretty sure thats what happens when you receive the police 20 minutes after that encounter and that it's not worth that much for me to investigate. Another point that's guaranteed is that it didn't smell like chemicals because I wasn't cooking drugs or anythings else that smells in my house lol.

I guess you will never know what prompted the police to come to your apartment and conduct a search of it. I would bet it was more than someone reporting they saw you wearing a mask.

After reading your (edited) post about the conditions at your apartment complex, I think you were smart to not renew your lease.

Yea but i'm not stupid i can make an inference that's probably true. Either I call the supervisor and they say it was illegal or they tell me they received a call about the mask as far as i can tell. There was zero evidence otherwise. When you know that you could have gone outside with or without the mask and it would have gotten you searched or not doesn't require a scientist with tests; its obvious. As far as renewing my lease i eventually left the entire state as i found cockroaches in the place that was 100 miles away but only like once a month not 10 a day. Although northern california has seasons, I moved to another place with seasons so it freezes most of the bugs during winter so you don't deal with them as much. So far i'm very happy not throwing cockroaches into my toilet/trash even if it's once a month. Now it's just spiders as you would expect in places with a winter. They come in the house when it freezes but the cockroaches die for some reason or they don't exist or something. As far as the call logs thats good to know but i'm almost certain they just say i was wearing a mask and its probably a drug lab in the call. I mean you wear a mask and pass 2 people then have the cops saying you were wearing a mask 20 minutes later. Where does that not add up to them calling the cops and them coming and saying that. Dumb people thats where lol :LOL:.

Well, at least you were not arrested for possession of bleach and Ajax. And it makes for a good story to tell. Hopefully there will not be a sequel.

In order to have any hope of any sort of legal recourse, you would have had to have filed a formal complaint with the department/city within 6 months. Because this happened at least a year ago, you're out of gas. Feel free to discuss this with a local attorney for verification.

I don't know what you saw drinking from the pool...but it wasn't a foot long cockroach.

I had a friend in high school who had a dachshund named Harold. Harold was a really mean dog but it was amusing to watch him go down stairs. He'd start off at the top going head first and by the time he reached the bottom he would be backwards. His rear end traveled faster than his front end.
