On a $1300 (orginally $2800)outstanding debt, any idea where to begin to offer them? If I offer them a lump sum do they make the assumption I have further funds? I'm thinking $700 to settle or am I way off?
You again should refer to TigerD's thread at the top of this section of the forum on negotiation. :)

Thank you Quincy for the well wishes, first call going out this AM, if it helps others I can post my progress and how I was treated

OK got off phone from law firm, they werent real easy to work with, said that there can be no lump settlement at all since I'm in default which I'm suprised at. Then they offered to lower my payment from $121 month to $81 but that they would still take me to court this Thurday and pursue a judgement against me plus I'd be on the hook for another $291 for court costs. Apparently if I heard correctly, the only way to stop next court proceeding would be to pay the past due amount of $1202 right now (to catch up) and this would also save me the $291 added court costs. They claim they cant change the orginal payment amount since I'm in default

So can I show up in court Thur and ask the judge to change the payment amount? I live in a small town and really want to avoid a court appearance. Or will I be charged the $291 just to appear in front of judge? Do I have any options left? Or is the law firm calling my bluff? If I get a judgement will they simply withdraw the funds from any bank account that has my SS number on? Can I ask for a continuance to work out arrangements but I assume that means more court costs?

Any advice would be helpful! I can afford $1200 to be taken out in one lump. Just like the sticky thread, I told the agent I may be able to borrow $ from my brother which of course isnt possible!

I find it hard to beleive that the law firm cant change the terms set by the court 2 yrs ago, I bet they are hiding behind this and passing the blame to the court system. They can accept whatever they want correct??

That was a terrible idea. Now you've suggested that you DO have access to the funds, so they are even less inclined to accept a lower amount.

I errored, I cant afford the $1200!! and no I sure didnt tell them that or anything to hint I have the funds, I told them I'd be borrowing from my brother

Not to add more posts, but a lump settlement never even got off the ground as they told me NO settlement, I asked to speak to a supervisor, she put me on hold for a few minutes and came back and told me what was in the paragraph from 4 posts ago, now Im thinking she really never asked her super and just threw that out as standard procedure!

They have no incentive to bargain with you at this point because they know you have a source of funds available.

Limited funds though, they never even entertained bargaining per our conversation but I assume they are bluffing, they were insisting they would not budge as the amt is court ordered, how would I counter that??
