An elderly relative with help from greedy relatives is suing me over a real estate issue. It was clear to the other side they were loosing and the attorney for the one suing asked for a break. The elder's attorney told her to go sit with dishonest relatives. He then asked my attorney to talk in a private room. According to my attorney (This was in his office) that If we did not offer a settlement the Elder would claim she was ill and having a heart attack. I know this relative well and know she fakes illness to try to get what she wants. My attorney said he would not take that offer as it was not an offer it was (and i forgot the word) but to me it seems blackmail or fraud or extortion etc.. But I am not a legal minded person I just figure this has to be very wrong. My attorney was visibly shaken by this and said the other attorney most likely did this type thing before. My attorney said he was very worried about someone real or facking having emergency medical in his office in this manner. My attorney said he told the other sides attorney after several threats to call an ambulance OR get back to the deposition. They called the Ambulance and made a big ruckus. I was told the others had made threatening statements thus was offered an escort to my car. NOW my attorney says for the first time in the 2 years we may lose if the other side keeps up this act. My attorney asked me to start writing up offers. in short give them money when it is clear they owe me a great deal. I do not feel this is right. I THINK my attorney has never dealt with this type of behavior and does not know how to. He is a good attorney but this clearly scared him. Seems like it is against the law for the other attorney to do this threat. If I can find an attorney to take the case who knows how to deal with this behavior. Is it ileagal what they did?? Can someone get a warrent then record in secreet what this attorney says and does or something??

Your attorney works for you. You call the shots.

If he doesn't have the guts to stand up to the other attorney, fire him, and get someone else.

Meantime, you are free to report the other attorney's behavior to the state Bar.

Before we push the OP to file a complaint, we need to understand that the OP wasn't actually in the meeting. All he has to go on is his interpretation of what his own attorney conveyed. If a complaint to the State Bar of California is to be made, it would be more appropriate if it came from the OP's attorney who has first-hand knowledge of the events.

Thank you for providing the name of your state.

Here are two links to information, the first to California Attorney Rules of Professional Conduct as amended in 2018, and the second to filing a complaint against an attorney:

https://www.calbar.ca.gov/Portals/0/documents/rules/New-Rules-of-Professional-Conduct-2018.pdf
https://www.calbar.ca.gov/Public/Complaints-Claims
I suggest you sit down with your current attorney to discuss the acts/actions by the other parties and their attorney to determine if Rules have been violated that warrant a complaint. From what your attorney told you, it appears that the other parties are playing a game that could work against them in the long run.

If after talking to your attorney you feel your attorney cannot represent you properly, you can search out a new attorney for a personal review of the facts of your case.

Good luck.

That is my Thinking But my Attorney is Spooked like YOU say I only know what my attorney said. Something scared him. I personally think my Attorney is a good attorney but has never had to deal with Trailer Trash junkyard dog types from San Bernardino. orange county is a wealthy area Not much of this kind of persons here. Mostly professionals. My Attorney IS a Pepperdine U grad. They are pretty straight arrows. I may be wrong but I THINK this is the Case. Now get this about 2 years ago this trashy attorney pulled a stunt trying to say I am via the contract (Witnessed by and written by the Elders attorney and one of my Attorneys) My attorney said this was not ok. I do not know the legality and he handled it and said it was no charge to me. I think he either threatened the BAR or told the Bar. Not sure He just said since Both Partys had attorneys Make the contract sueing me for elder abuse was wrong I just do not know how Wrong. I also THINK cant Prove that the trashy attorney is sleeping with one or more of the greedy family members who are Forging Signatures and in general driving this suit. Only the two Attorneys know what was said. But I think the trashy attorney did more threatening or something than I am being told.

You really have an elitist attitude and it really make you seem trashy. I know OC, LA, SB, etc. I am a local. I've been in places in SB County that would make you drool, and I've been in places in OC that made me wish I had my gun with me.

I recommend that you are very careful with your words when describing the other attorney. His reputation has value. Harming it can result in a costly lawsuit filed against you.

If you don't think your attorney is up to the challenge of fighting against the other attorney, you can terminate your relationship with him. I would not do this before sitting down with him to discuss your fears, and I would not do this before you have another attorney lined up to replace him.
