Are they breaking our union contract?
In our contract when we work lunch duty and still get a lunch break they pay us our hourly wage. But in contract it says we receive the CMEA rate instead of our rate. 13.7 C states Busd duty and lunchroom duty are not extra-duty assignments. Employees will not receive additional compensation for bus duty which occurs during work hours. Employees who agree to perform lunchroom supervision for one semester or one year will be compensated at the same rate listed in the CMEA contract work for only one semester will be prorated. If an employee is required by the supervisor to give us his/her duty free lunch or duty free lunch and break period, they will be paid an hourly rate listed below. 45 minutes 22.50 30 minutes 15.00 This is a contract negotiated through our union and IEA and school district.

No, they are not breaking your contract. They might be breaching a rule within the contract but they aren’t breaking the contract.


Another problem is you have posted self chosen excerpts from the contract to post. What you wrote is a bit muddled.

It is not proper to attempt to interpret a contract on this forum. You need to speak with either a union rep or an attorney who has access to the entire document and can properly interpret any rules that affect the issue at hand.

And what did they say?
Union said they talked to IEA and they said that the way they read it we don’t get paid unless we give up our duty free lunch and break. The amount listed at 22.50 is less than what teachers get in there contract the get like 4000 we barely get 2000. The president of the union is new to being the president and listens to what IEA says instead of fighting for us.

Is there a lawyer that can look at the whole contract and give feedback. It’s on the districts website and I have a copy all members received. I just feel like none of them listen to us.

We cannot analyze contracts. That goes beyond the scope of this forum. You will need to find an attorney licensed to practice in your jurisdiction. Sorry.
