Never filed an car accident claim and Medical insurance will not pay hosp. bill

I am not even sure how to start. I drove my step dad to a friends house so he could diagnose his car. My friend backed his car up to test the clutch but when he went to pull the manual car forward the brakes did not work and he gave too much gas, My step dads leg got crushed between his car and a parked car(not working) in the drive way.
It broke his leg and we called the ambulance to take him to hospital. That was April 28th. At the time he just gave his (my stepdads) health ins info. He has been on disability for 4 months now and there is still swelling in his leg so he cannot work his type of job. My friend says he did not have ins. But he had just bought and registered the car that month so I am pretty sure he had insurance for that month only. He will not give us any ins info now and does not have it anymore anyway. Does my stepdad call his ins to try to get the bill paid? Is it even possible since his car was not involved at all? and is 4 months to long? and even if we were to get my friends carrier he will probably not cop to it now anyway. Even though there is not a police report the ambulance driver was told exactly what happened as well as a neighbor. Not sure if that helps. Yes I know he is not really a friend I am just being nice. If my friend does not call his old ins company to claim fault what are my step dads options to get his medical bills paid? so basically this is the jist. Car accident to pedestrian. person at fault never called his ins co and probably never will. He was only insured for 1 month. and step dads health ins will not pay hospital bill. Is it too late for my step dad to file a claim with his insurance when we cant even get the person at fault to make a statement? We are so confused on what to do and I feel responsible for taking him there in the first place.

Your stepfather will have to sue the guy who caused his injuries.

Why not? Is there an exclusion for auto related medical bills? StepDad needs to read his medical insurance policy.

If he has Medical Payments Coverage on his own auto policy he can still submit the hospital bills to his own insurance company. There's is usually a year to do it. Might not pay much as Medical Payments Coverage is often $1000 but sometimes $5000 or even $10000. Check his policy. It would say the amount right on the Declarations Page that summarizes his coverage.

As for anything else, he would have to sue your "friend."

Rest assured that, if your dad's medical or auto insurance finally does pay the bill, they WILL seek compensation from your friend (and your dad is required to assist). This is called subrogation.

Please clarify, becaues the pronouns have me confused: the "friend" was driving stepdad's car to test/diagnose, and ran over stepdad because the brakes of stepdad's car were faulty?

I think step-dad was taken to the friends house to diagnose the friend's car. The friend's car malfunctioned, causing the injury to step-dad.

sorry no my friend was driving his own car, which is the car that hit my stepdad. My stepdad did not have his car with him at all.

thank you. Spoke to the friend today. He gave me the name of the insurance company but he is not going to call them to file a claim. He was willing to accept a call from them if they called. There is nothing to sue him for since he is an unemployed 27 year old and nobody wants to sue. We just want to find a way to get the medical bill paid. He only had insurance for 1 or 2 months and it was liability only. wouldnt it be best for his insurance company to pay the medical bill opposed to getting attorneys involved and suing for lost wages and compensation?

Have you and stepdad filed a police report?

Yes, there is something to sue him for - he has a car, a car which by state law he is required to carry liability insurance on.

And, maybe if you sue, it will wake him up to the idea that he should try to place an insurance claim.

He doesn't seem willing to do what's needed to help your stepdad - I think you should reconsider the meaning of the word "friend".

The friend's insurance isn't going to pay anything unless your stepdad steps up and calls the insurance company to file a claim (You can't do it for him). Doesn't matter how long the friend had insurance as long as he had it on the day of the accident. Your stepdad doesn't necessarily have to get attorneys involved and sue for lost wages and compensation.
