Got suspended from eBay...need some help

My account was suspended from eBay. I received the suspension e-mail, BUT there was no reason as to why my account was suspended. I e-mailed the President of eBay because I explained to him I have been trying to get in touch with the Trust & Safety Department for a month and they still have not responded to my e-mails. He e-mailed me back with a representative from the Trust & Safety Department (look how far I had to go to get someone to respond to me). This rep sent me an e-mail stating that I violated Section 9 of the member agreement. The guy wrote me this:
"I reviewed your account and determined that you were suspended under
Section 9 of the eBay User Agreement. This section states that eBay may
immediately warn, temporarily suspend, indefinitely suspend, or
terminate your membership if we believe that your actions may cause
financial loss or legal liability to you, our users, or us.

Upon reviewing your feedback and recent auctions, I see that a lot of
this may be caused by misleading information in your auction listings. I
noticed that your auctions have PayPal listed as a payment option, yet,
in your feedback, many members are saying that you will not accept
PayPal. I also encourage you to list shipping prices in your auction
listings, so that buyers know what terms they are agreeing to, before
they place their bids. Keeping your auctions clear and honest will bring
you more bidders, and better, safer transactions."

First of all, my auction STATED LOUD AND CLEAR IN BOLD FONT THAT I DID NOT ACCEPT PAYPAL! I don't see how anyone could have missed that. And secondly, I have had so many Non-Paying Buyers that I filed complaints for and when they never responded to it, I closed the complaint and left negative feedback because it's just not right to have people who bid on items and not pay get away with it. So I left them negative feedback (I had like over 20 people). Then all of a sudden, all of those Non-Paying Buyers started leaving me negative feedback like "I" did something wrong! My feedback dropped down like 30% from all of this. And then I had one girl harrass me saying that she was going to do everything in her power to kick me off eBay. I'm sitting there thinking "What did I do wrong?" They didn't pay. Everyone knew that they would receive their invoices at the end of the auction with the correct amount of shipping. And some got so mad because USPS prices were so high and they didn't want to pay for it. Like that's my fault too? Please help me and let me know what I should do! :(

You should move on. eBay obviously felt there was reason to suspend you, and it's within their rights.

Personally, I don't believe you're innocent in this. There's a good reason so many users left you negative feedback, and also a good reason why eBay suspended you. I've been selling things on eBay for years without any problems, so I don't know what you're doing wrong!

I seriously didn't do anything wrong. All of the Non-Paying Buyers I left negative feedback for also left me negative feedback with an excuse like "I didn't accept Paypal." It was stated in the auction that I didn't accept that payment. I took BidPay auction payments and I also had a checkout link posted on all auctions, but only a few of the acutal buyers paid through BidPay, some paid by cashier checks, and some money orders. More than half of my buyers didn't even pay. I e-mailed them, but they never responded back UNTIL I left negative feedback after closing the Non-paying Buyer dispute.

E-bay is a private business and doesn't have to let you do business with them.

Period.

Well that's not really advice. I'm stating my case looking for some advice maybe to help me. I still can't see why I was blocked. It was really ridiculous. If you're not going to give me advice, don't bother posting anything on here.

Yes, this was advice.

In fact, it was correct advice and the ONLY answer.

eBay is fully within their rights to do exactly what they did. There's nothing you can do about it. I find it hard to believe you have no fault in this if so many people had issues with you as a seller.

The only issue I had with buyers was that more than half of them didn't pay. They didn't even repsond to my e-mails. They all received invoices within 24 hours of the close of the auctions. I seriously didn't do anything for these non-paying buyers to leave ME negative feedback. All of the e-mails I sent to all of the buyers were ignored or their e-mail address through eBay was invalid (which I find hard to believe).

Something in what you're saying doesn't ad up. Yes, there are a lot of buyers who don't bid, but most still do (unless we're talking ebay motors, and that's another topic entirely). So you for you take an admitted 20+ people not pay, something is wrong. One bidder mad that you don't take Paypal is one thing, but so many of them? I can guarantee it's not a conspiracy. Make sure Paypal isn't automatically inserting a symbol in your auctions from a time you did accept them. Any why on earth not use them? I won't bid unless I can pay by Paypal. They also let you print of shipping labels and save a trip to the post office. I know Paypal has it's shortcomings ( www.paypalsucks.com ) but there's little you can do to avoid it in the auction world these days.

Now, about shipping. How much do you charge, how do you end up shipping, and why don't you tell people this? What happened to me last week-I bought some socks for my hubby. His size is hard to find. Okay a few bucks for a dozen. No shipping listed and I ASSUMED it would be reasonable. $10. That's what the seller wanted. My fault for not asking ahead of time, but a lot of people will leave negatove if they feel you left the shipping amount out to gouge them later when they were stuck. Taking advantage of them.

So how much are you charging for shipping? Is it fair? Do you charge $8 only to ship media mail, regardless of contents?

And, if your feedback dropped 30% on 20 negative remarks, you only have about 65 remarks total. Try making a new account and having HONEST auctions this time. Or I will kick your ass. I'm tired of dishonest sellers complaining when things catch up to them-and gouging on shipping is dishonest!

Well Ebay has suspended my account WITHOUT any reason. The people in the trust and safety won't respond to my emails. I wish I knew how to email the president. They send me these form letter responses (well the two that I have actually gotten!!)

And that is it. I have been selling on ebay for a grand total of one month!! I have sold everything I list, just by luck. And I have no idea what they are referring to. I wish I did. I have sold the following items on ebay... clothes. My sons old clothes he grew out of. So, what rights do you suppose I am infringing on?
There is no customer service. I have absolutely no recourse. And yes Ebay is a privately owned entity, and yes they are the bosses here. But... there is that pesky little user agreement, those policies that they require ebayers to agree to adhere to. But in doing so, in offering such policies, don't they have to at least follow there own protocol and policies that are outlined in the user agreement? Seriously for all of you that are going to read this and say "whatever. You did something or they wouldn't have ousted your butt. " I did not infringe on anyones intellectual property rights, for those of you that don't even know what that means, like I didn't, it means selling something that is under the protection of a copyright. So if I sold my car, that is alright, but if I tried to sell the name "Mercedes Benz" then I would be infringing. I think. (My car is a Honda, by the way. :D ) Or selling some OEM software that you get from Compusa with a computer, but not selling the computer that goes with it. Ok, I did not do that. I sold items that are not under any copyright and by selling them I didn't infringe on anyone's anything. ( HUGE LOT OF BOYS SIZE 3T, LIKE NEW -- not at all infringing!!)
So Ebay screws up, let's just say for the sake of arguement, (I know like saying GOD forgot to add a day... ) do they get to be held accountable? NO. probably not. Then there's the folks out there that paid me and now I am gone in a puff of Ebay created Smoke, they want to know if anyone is held accountable for there cash going in the toilet, because not only can I not contact these people but I am unable to access there shipping information, Ebay says I infringed on someone somewhere and Ebay won't let me see any of my auctions. Or any of the buyers that I owe either money or goods to. I think that Ebay and the affectated fops working the nonexistent customer service booth that are too busy shining there brass rings to respond to the some 50 emails from a housewife in Reno, Nevada should all go pound sand up there .. And I would be willing to bet that there are about 50 housewives around the USA that feel the same as I do... Thank you. :eek: for listening to my complaint. HOW DO YOU FEEL ABOUT THAT??

selling used clothes on ebay

i believe one of ebay rules is you can not sell used clothes of any kind. unless of course it is a collectors item, so that may be where your problem lies.

My boyfriend sold a lot of stuff on ebay. Old collectors baseball cards and etc. His account got suspended because ONE bidder filed a complaint because he CHOSE not to purchase insurance and the card got damaged. My boyfriend took a complete loss on the card, because he spent soooo much money to ship it. ie-box, bubble wrap, sleeve, another box. But the guy wanted it for his sons b-day, so my boyfriend sent it UPS. Now, i used to work for ups, and they distroy boxes, so I wasn't suprised.

But anyways, the guy complained, and ebay kicked him off. He tried to get in contact with them, he never did. So he opened a new email account, changed his login user name, and went back on and started selling from scratch. It sucks to do that, but he had to.

I have bid on things before, not completely reading the auction and realizing after i bid, that they said they didn't accept paypal. I would just make sure that next time, i put in bold bold bold bold bold capital letter at the beginning, that you don't accept paypal.

That is absolutely amazing since so many people sell clothes on Ebay & they have different categories & everything. :rolleyes:

You can not sell used UNDERWEAR or bras.

Not clothing in general....... geez - I have bought and sold tons of clothes for both myself and my son on e-bay!!!

CUTI: There is a class (joined in the last few years) of ebay users that MUST accept PayPal. The listing forms won't allow you to turn it off. The fact that your listings have this automatic inserted requirement is no way overridden by you sticking text in your listing saying you won't take paypal. You were clearly in violation of ebay's rules and they were justified in suspending you.

HEATHER: Opening new accounts to sell on ebay when you have been suspended is also against the rules and if they catch you, you'll be gone permanently. Your BF didn't get suspended over one user complaint. Sorry, doesn't happen. There's more going on here.

LAZY: If you get a VERO takedown it is because someone is asserting copyright or trademark rights to ebay. You don't get suspended over one VERO, but several will get you kicked off. You need to be very proactive if you get a VERO. You got a letter about those auctions LONG before your account was suspended.
