DW and I have been married for 7 years and we have a son together. I have been on H1B and DW on H4. Our marriage does not work and DW wants divorce. We both want DW to stay in the US so we both can raise DS together.
My green card is in petition for GC stage (approved LC) and the company is proceeding forward. If DW gets GC from this and immediately or shortly after we get divorced, would our GC be considered fraudulent?
