What is the name of your state (only U.S. law)? COLORADO
My son who is months away from turning 18, has just received a MIP of Tobacco. The schools resource officer gave him this ticket because a video that was given to the school of him using a vape on the bus. The video that was shown is very vague and pretty much nothing can be seen. In addition the time, date, and place stamps are all inaccurate. We want to try to fight this but don't know if its worth it. If anyone has any advise it would be greatly appreciated.

Possession of a tobacco product by a minor under the age of 18 is a noncriminal offense in Colorado. Here is a link to the law:

The school probably has a policy against using tobacco products on school property, which includes school buses. You can refer to the school handbook to see what the possible penalties are for violating a school policy.

Although you say the video is "grainy," there are no doubt witnesses who can testify to your son's use.

What exactly are you fighting? A school penalty or the ticket, or both?
