I lived in a home for 4 years, during which time some shrubbery including a large Pittsosporum and 5 rose bushes died as well as we removed two large vines that were engulfing the back patio. These plants had been gone for at least three years during which time the landlords had been over on several instances and made no comment as to the condition of the yard. Now that we have moved out we received a letter at our new address stating that they are keeping our security deposit ($1000) for the cost of replacing the shrubbery as well as extra money kept because when the new plants are put in they will not reflect the maturity of the old ones. We did not receive an itemized list of what they will be replacing. So really I have two questions...

1.) Is it legal to keep extra money for the lost "maturity" of the old bushes?
2.) Can they say it will cost a certain amount to replace the bushes, keep the money, and never really replace the bushes ( we do not think they really have any intention of replanting the shrubbery)?What is the name of your state?
