Under the Birthday Rule, who's insurance wouldbe primary? The father has state medical insurance his birthday is in August. Mother is covered under new husband's insurance policy through the Union. Do we use the mother's birthday or the policy holder (step father) ? Mother birthday in May step father birthday in November.

That is a question that is determined by the policies themselves, not by law. You would need to contact the insurance carriers' Member Service areas and ask them what their rules are.

If you mean Medicaid as "state medical insurance" then that is ALWAYS secondary.
