What happens to the partition action once the foreclosure is filed?

Yep I did. It was an incredibly complicated situation at the time. Under what laws and theories can she claim damages? @quincy The buyers signed an agreement holding me free of liability for walking away and it released their earnest money so they're out of the picture. It's her I'm worried about.

What happens to the partition action once the foreclosure is filed?

Wow that's quick on the foreclosure. Thirty days notice is up at the end of this month. I'm not sure where the partition is. Nothing more has been filed since I think October or November, and the last thing was the referee's oath. That's it.

What happens to the partition action once the foreclosure is filed?

Hmm okay. Filing for foreclosure doesn't cause a stay on the partition? And is there an "average" time from foreclosure filing to final order?

What happens to the partition action once the foreclosure is filed?

Yeah that conversation happened in October before things turned into a fight to the death. There's other court battles that are entwined with this one. The other battle turned ugly and it's bled into this one and there's hard feelings all around. The house should've been listed and probably...

What happens to the partition action once the foreclosure is filed?

No, it was a phone consult with my mother's lawyer. He was doing me a favor and handled some negotiations with her lawyer that all fell through. And yeah he told me it would be a waste of money to pay the mortgage since I won't get any money back out of it. He's a very good lawyer with a...

What happens to the partition action once the foreclosure is filed?

@bcr229 @LdiJ @FlyingRon @Mass_Shyster Thank you for all your responses. I only ask for curiosity and because I'm trying to figure out what to expect. She's certainly taken every opportunity to drive a stake in me so I worry what's up her sleeve. I don't have a lawyer for any of this and I've...

What happens to the partition action once the foreclosure is filed?

Yes. The bank calls her too and I've also told her. Asked her to come to a deal with me (asked her lawyer actually). No deal. She asked the court to evict me when she started the partition. Things have come to low dirty blows.

What happens to the partition action once the foreclosure is filed?

On that's fair. I guess my question is more is the partition going to proceed or does it stop since the bank is taking the house?

What happens to the partition action once the foreclosure is filed?

What is the name of your state? Iowa So the house is scheduled to have a foreclosure filed any day. It's also in the midst of a partition action. Things have gotten beyond contentious so there's no chance for an agreement about selling the house before the foreclosure happens. What happens to...

Quitclaim deed in lieu of foreclosuure?

@Taxing Matters Yeah the bank needs her signature, too. Something about it being an FHA loan and having strict standards. Would there be anything wrong with not contesting the partition or foreclosure?

Quitclaim deed in lieu of foreclosuure?

Thanks for your answer. I hadn't even thought of the tax implications. I'll see what I can do.

Quitclaim deed in lieu of foreclosuure?

She sue for partition after she ignored 2 months of me asking if we could list the house. She also asked the court to evict me so currently the house ig vacant. I owe her nothing. A lawyer I called advised I not pay the mortgage since I won't see any money back in equity. So can I sign a...

Quitclaim deed in lieu of foreclosuure?

What is the name of your state? Iowa So I co-own a house with a woman who took off on me last year. We're both on the deed and mortgage. She chose to sue me for partition a few months ago. There's hardly any equity in the house and I don't see the purpose in fighting over the breadcrumbs. The...
