Previous apartment trying to charge me rent when I don’t live there anymore.

We are having a problem with a previous Landlord. They send our alleged debt to a debt collector for $4,000! Apparently for rent we “owe” and damages.

Here’s some specifics:
We moved into our old apartments December 1st 2018. We signed a lease for 12 months. We put in our 30 day notice mid to the end of October 2018. We let our Landlord know we were moving out and that we had signed the 30 day notice at the leasing office. Our new apartment let us move in early, so we did and still paid the month of November in full. We used the next week to clean the apartment and leave it tidy. There was a big earthquake here on November 30th 2018. Our tenant texted us to ask if here was any damages in the apartment on (nov 3). We said we would stop by before turning in the keys to check. No answer. So, went back to check the apartment on December 4-5(I’m not sure) to make sure there was no damages. The top lid of the toilet was shattered and some stuff in the kitchen broke but nothing mayor. We texted her again to let her know. She angrily told us to turn in the key and that there was no need for us to be there. (Maybe she was right about that but we just felt we had to check. I mean, right?) so we immediately turned in the keys that same day.


We didn’t hear from them again. We didn’t get our deposit back. Yes, there were some damages caused by us aside from the earthquake but they were minor. Two door frames our two dogs chewed on but it was minor. That’s it. We assumed they just used our deposit for that so we never asked for it back.

THE LAST TIME WE HEARD FROM THEM WAS WHEN SHE TOLD US TO TURN IN THE KEYS IN DEC.

Fast foreword to today, June 24th, 2019. We get a call from a debt collector saying we owe 4,000 dollars in rent and damages! He said we owe rent for the months of November, December, AND January (Our rent was $1,250 x 3 months = 3,750) + damages totaling to 4,000! We have receipts of every single check we sent them since we started living there up to November. We have proof we’ve been living at this new apartment since November. We have all the conversations on Text messages. The only thing we don’t have is a copy of our old lease because it’s been like 7 months since we moved out of there!

We’re in awe and don’t know what to do or what our options are. If there’s any advice anyone could give it would be very helpful. Thank you.

Did your lease end in November or did it end at the end of February?

As LdiJ asks, what is the actual effective date of the lease? Did it run December 1, 2018 to December 1, 2019?
Why were you late returning the keys?
It would seem that you owe November for sure. You may owe some or all of December if you kept them from being able to rent the unit.

It would seem that you owe November for sure. You may owe some or all of December if you kept them from being able to rent the unit.
She said that they paid November in full. Plus they kept her security deposit. They were late however in returning the keys since they did not do so until December apparently.

The OP needs to clean up their original posting to make certain they are correct on their dates as well as answer the question as to which state this took place in.

Currently they are indicating they moved into their apartment on December 1, 2018 when they perhaps meant 2017 since they gave notice of not renewing their lease "mid to the end of October, 2018".

Since they remained in possession of the unit by NOT turning in the keys until December, it is understandable why the landlord might be charging rent for that month.

However, since they do not indicate which state this took place in there is no way anyone here can comment on the issue of when/how the landlord needed to notify them of the status of their security deposit (for example) nor the specific route they needed to take to notify the landlord that they were not renewing their lease.
