  Oh, he definitely should have an attorney. Even if he loses and his state requires some small payment towards the cost of that attorney as part of restitution or penalties, it's still better than NOT having an attorney where he could get raked over hot coals.

  Pursuant to state law, a warrant is not supposed to issue from a single infraction FTA. But, that rule goes out the window when you have a repeat offender as our OP appears to be. Not every jurisdiction will do so, even on multiple offenses, but it is sufficiently common that we will find it.

  I believe he stated he was in Oklahoma. Of course, PROVING his claims will be nearly impossible, so even on the off chance that there is an angle under which he can pursue a civil claim, it'd be nearly impossible. And getting an attorney to take such a case without a hefty retainer is unlikely.
