Mom's legal address is in NY, in hospital/rehab in NJ
Mom is in the hospital with mild covid (89 y/o) / Hospital delirium has set in. My brother has health care proxy and I am the alternate. He has made all of the decision without consulting with me and this is not what my mother wants. He is...
New Jersey
I just got laid off but the employer agreed to let me stay with the company until end of September for health insurance reasons and I have a procedure in mid September which the insurance has fully covered etc.
My replacement has been identified and she is already on board and I'm...
As far as I know, it's unchanged. Since I am the trustee and manage the "house" trust, I am still get the tax bill that I pay/manage. I am still registered in NYC and being the trustee if that makes sense. I my brother had been named, he would be getting the bills to pay and that is not the case.
Also, let's say something was done w/o me knowing about it (which would not be legal) since I would have to agree to it... Correct??? Wouldn't I have been informed that I am no longer the Trustee?
I read thru the document and it says..."The Grantor may discharge a Trustee, Co-Trustee, etc. for cause or without cause, absolutely in their sole discretion....... I guess this means that my mom can remove me as Trustee of the Trust. Would it even hold up at this point since it is an...
NeonMoon... where would I find such wording where it states the grantor (my mom) has the right to designate a new trustee (myself). Would that be in the first few pages of the trust?
All other asset's listed on the well of my mom's has both myself and sibling listed as equal distribution beneficiaries and we have to both be present to claim the proceeds, 50/50
Thank you Zigner. I just find it odd that my mother's attorney didn't catch on to what my brother was trying to accomplish or even discuss w/ my mother and brother that the Will and Irrevocable Trust are two separate documents. Or, perhaps he does know and kept quiet about it and led them both...
Just to be clear on a statement made in your response.... Can a change in the Will dictate the outcome of the Irrevocable Trust? I thought and have been told my several sources that they are two separate vehicles and each dictates the outcome. The Irrevocable Trust owns the house and I am the...
My brother's sole intention was to get my mother to change the will so it would read that he gets his share immediately. My mom does have cash, IRA's, liquid assets as such which would be cashed out and distributed immediately to him. As far as I know, my brother didn't get a copy of the new...
I went thru the Irrevocable Trust and there is a paragraph that reads:
""SECOND: The grantor reserves unto the Grantor, a limited Power of Appointment to change or alter the remainder beneficiaries of said Trust Estate by Will duly executed or by an instrument in writing, duly acknowledged and...
Question regarding the new will that my brother made my mother do..... Is there any clause that can be put in there stating that all other documents are null and void even though the Trust is a separate document. I think the answer is no and that the two documents have their own instructions
As far as my brother is concerned, he thinks that the current Will has voided the previous disbursement instructions and that he is getting 50% upfront. The fact that the deed is entirely a different document and the rules are entirely different is something that I will hold very closely and...
