That appears to be very helpful - although CRCP 98 does not appear to be specific about domestic relations cases. However, the custodial parent has filed a motion to modify the out of state order in the 'old' county (despite having no subject matter jurisdiction to modify the out of state order)...
This is a Colorado Family law question.
There is a out of state parenting Order controlling the visitation with a child who is largely in the physical custody of the non-custodial parent with a (very far away) out-of-state resident parent. The Order is properly registered as a mirror order for...
I fear you misunderstand me. I have found this exchange useful. It is not my purpose to try to change opinions. I simply sought information.
I have an appointment which I now must keep.
Thanks. I think you may be right. I do like to try to check the law, though, when someone else consults a legal advisor as, besides the facts of the case sometimes getting misrepresented, the legal opinions don't always stack up. I have seen some (as now acknowledged) VERY wrong 'authoritative'...
That's how the school change info finally came out (video call)? AFTER the event. Mother or granny supervises call at the other end so certain topics often don't get raised if child feels other parent would be uncomfortable with it.
The school has been emailed the relevant Orders. It is a public school so they are addressing the issue of conflicting information (don't know what the other parent has provided which conflicts) with the School Board legal advisor. I understand the 'contempt' route but am concerned to not use...
Here I think you are both right and wrong. It depends upon what is being withheld. 'Material Withholding' is treated very seriously by courts in pretty much all jurisdictions around the world in certain circumstances. Fraud can be established on the basis of material withholding just as it can...
You are right that the info which I specified is not required to be provided by the school;. However, the school DOES require the provision of some related information. I recognise that the law is different between States. I was just looking for something somewhere.
Yes. But that is only true if the non-custodial parent is informed of the school or doctor. Also, the school or doctor is naturally cautious at someone appearing out of the blue and contradicting the story they have been told by the 'nice' 'sole parent' (sic) of the child. Thus, it may take some...
I thought that I had effectively done so in the question. A primary custodial parent (5/6ths of the year) is repeatedly not informing schools, doctors etc of the existence of the other parent who has full shared legal custody. This is less than helpful, to put it mildly.
I have found a NY High...
Thanks for that.
But separate from providing contact details, is there not any obligation of a parent contacting statutory services for a child to provide honest full information about the child's main circumstances (eg the existence of another parent who shares legal custody) to those who...
The Custodial parent would, I think, do so if that parent perversely wished the therapist, school, hospital and/or doctor to remain in ignorance of the existence of, and how to be in contact with, the other parent.
(This is a Colorado question although I imagine there may be a lot in common in the answer from different States of the Union)
Does a custodial parent of a minor have any underlying legal duty to inform schools and doctors, therapists etc with details of the existence of the other parent...
