California. 1st time offense. assault with a deadly weapon. Pointing a gun at an unwanted guest in the home.. then proceeding to follow them outside and firing a warning **** at ground as they leave. 2felony charges. What is the sentence ?

(2) Any person who commits an assault upon the person of another with a firearm shall be punished by imprisonment in the state prison for two, three, or four years, or in a county jail for not less than six months and not exceeding one year, or by both a fine not exceeding ten thousand dollars ($10,000) and imprisonment.

Looks like he's facing at least a year and up to eight (as well as $20,000 in fines plus costs) if he's convicted of both.

Restraining orders are not always effective in preventing domestic violence, by the way. The one restrained has already shown s/he has little respect for the law. Vigilance by the person abused will be necessary to prevent the abuser from future violence. It will be important to contact the police immediately if the restraining order is violated.
