If you were charged in 04 sentenced in 05 to one year county and 10 years probation. Then that probation was revoked after 8 years. You had a withheld sentence so you went in front of your judge and was given 5 years in prison and 5 years extended supervision. Did the prison time then was released and was out for 1 year when your extended supervision was revoked what is the max time they could give you and would you leave the prison with extended supervision If you did your max time. No other charges on your record except for this one. Thank you for any help.

Without reading the actual sentencing document, I would suspect they can give you four years. Someone who can't avoid breaking the law that much should have an attorney on speed dial who is up to date on your situation and can answer such questions.

Technically, he could likely sentence you to the maximum prison sentence for the offense you were convicted (less time served) depending on how you were sentenced/resentenced.
