judgment but indemnified, HELP

I have a judgment against me because of a business loan with my ex-husband. At the divorce, he took the business and all of the assets and liabilities. I was idemnified.

The business went belly up, he went bancrupt after he gave the assets to the business away in an agreement with another company. I was indemnified against any lawsuits or debts associated with the business, but now I have a judgment against me for $14,000

At this point hiring a lawyer will cost me more than the judgment so I want to try to go after this myself. I was hoping that someone can help me figure this all out so that I can go after my ex and his partner for the assets and tell the people that has a judgment against me to go take a walk.

And is the judgement directly related to the business in which you were indemnified of? One can have a judgment cast against them, and it can be for a totally different matter. If the judgement *is* for that which you were cleared of, then produce such records to the courts for further review. Were you served a summons for this judgement? Did you show up or answer the summons?

It was a business loan that I did sign personally for. I was supposed to be indemnified for any of the debts associated with the business. It was in the company name, but we signed personally.

How can I cast a judgment against them? Who?

I need to open the case and call in my ex and the partner who he gave all the assets to. They actually took all the assets from the company and waked away from the liabilities and left me holding the bag. The original company went bancrupt, but the partner's company is still active. I have very little proof except for the indemnity agreement in my divorce because I left the company years before my divorce.

I never recieved anything until after the judgment was formalized.

The business loan was Chase Manhattan bank and the judgment is for the amount due on the loan. Again, my ex and I both signed personally. He went bancrupt and walked away from the lawsuit leaving me held responsible. The suit went unanswered and the judgment went via default.

My response:

Well, simply stated, you're screwed, blued, and tattooed.

All that's left for you is to pay the judgment or file bankruptcy yourself.

I Have done fine so far and protected my assets through joint accounts.

I have already been told by another attorney that I can reopen the case. I was never served. I was hoping that someone would give me the advise as to how to re-open the case bringing my ex and his ex-partner into it. They had the assets and should of been repsonsible to pay to debt.

Lastly doesn't the indemnification have any merit because it was directly related to the business?

My response:

Lady, you're not understanding what Bankruptcy did for your ex-husband and his partner. They are no longer legally liable for the debt. You're the one left holding the bag.

You can probably have the default set aside. However, then what are you going to do? You have no defense to the debt. Your marital settlement and the indemnification agreement is useless, and means nothing to the creditor or the court - - and that's because the gentlemen have gone bankrupt.

The partner still has a viable business and has not gone bancrupt. He would be the one I would go after. He took the assets of the business. So I think what you are telling me is that since he went into an (illegal) arrangement with my ex and the business, I would have to go after him?
