I'm.sorry,.my.spacer.key.is.stuck,.I'm.in.California.and.I.need.case.law.that.
says.a.substitued.judgment.is.covered.by.res.judicata.and.or.collateral.estopal.
Or.in.any.state.that.has.substitued.judgments. :confused:

Thank.you...there.was.a.substitued.judgment..in.probate,court..for.this.mans.
revocable.living.trust..Everyone.noticed.everyone.present.including.the.man.
whose.trust.it.was.he.was.competent.etal.,Now.it.is.being.challenged..in.civil
court..on.breach.of.contract..but..we.say.collateral..estopel.res.judicata.judge
says.NO!

Wait a minute... there was a declaratory judgment action for the will, e.g. while he was alive, and it was declared valid?

Then it was contested after he passed, and the judge says the previous judgment is invalid?

What are his reasons for that?

The.plaintiff.is.stating.in.a.civil.litigation.for.breach.of.contract.that.he.is.not.
attacking.the.trust...but.the.beneficiary.for.inducing.the.man.to.breach.an.oral
agreement.that.the.man.had.with.his.deceased.wife..had.an.opportunity.to.
raise.this.at.the.probate.hearing.and.didn't.. :confused:
