I am an 18 year old male high school senior dating a 15 year old female high school sophmore.We have been dating for 4 months now, and I have the blessings of her parents. They have even talked to her about her having sex with me etc. I am curious to know the laws regarding sexual intercourse with a minor but also the laws regarding sexual acts with her. We have engaged in sexual activity in my car before and now I think that is punishable by law. Please help me so I don't become a target to have a misdemenor on my record etc. Thank you

Yes you probably could get in trouble for have sexual act and sex with her, she's a minor. And I would suggest not engaging in it again. She could whined up pregnant, and no codoms and pills don't always work. I've known a lot of teens that have ended up pregnant and most of him ended with a sad story to tell. Your the adult in this relationship, do the right thing and don't mess up her life as well as yours. I don't think you want to be a dad at 18. Be wise and wait.

Thank you for your opinion on the matter. We are not planning on having sex anytime soon. The issue I am more concerned about is that we engage in sexual acts but not sex. Does anyone know the laws surrounding this issue in California? Am I legally allowed to have sexual relations with her as a minor if it does not include intercourse.

No, my real name is not Bill Clinton. I am in a relationship with a girl which I believe has potential to be long term. If anything, I am a smart 18 year old who actually cares to know the laws regarding things I do so I don't have to have a bad record. Instead of making low inferences like that, maybe applaud me for having a level head and caring about my future as well as my girlfriends. Those sites are helpful but reading through hundreds and hundreds of lines of confusing laws is not easy and interpreting it is also very hard. Any more help from anyone is much appreciated

Seeing as how you have the blessing of her parents, that does help, however, if they decide that one day they don't like it they could press charges.
But I do think if an police officer catched you guys in any act, probably would arrest both of you, call her parents, and I believe it would be up to the parents on whether or not to press charges, but the law could take it in their own hands. I'm not too sure

My advice would be to keep things slow and steady, and then when she turns eight-teen, there wont be any problems with you being together.

Dating is okay ... sexual acts - including fondling, touching, groping, etc. are illegal. Her parents do not have to press charges and neither does she - the state will press charges if/when it comes to light. And trust me, it will. Kids talk - girls most of all ... they tell friends, friends tell friends, someone tells a parent or a teacher ... oops! Someone already knows, and eventually someone in authority probably WILL find out.

To lessen any impact of the potential charges, you need to cease any sexual contact whatsoever. And unless you want to be a registered sex offender for life, you better keep those hands to yourself and be a respectable gentleman until she's 18.

But, we all know that you won't be able to resist, so just be forewarned that a little nookie and tochyie-feelie today can result in a lifetime of annual visits to the local police department to register as a sex offender.

Am I wrong when I say that I can't be charged with rape etc. just because people talk. My girlfriend and I are highly private and I know she does not talk to her friends about what we do. We go to a small private school and if word got out then it would be around very fast. But would it actually be possible to be arrested etc. just because someone told someone in authority without any evidence? All you cynical people responding to me saying I'm stupid and won't listen to your advice, cut that out. I AM listening to you or else I would not have started this thread. I respect every piece of advice being giving to me and I thank everyone so far. Please continue with any more advice or laws you may know of and thank you again.

Trust me, someone knows - or will find out. It happens.

Yes, it IS possible for you to get arrested based solely upon the word of another. Their is a vast gulf between an arrest and a conviction, however. So while you might be arrested, the evidence necessary to sustain an arrest may not be enough to sustain a conviction - or to even file charges. But, is this a chance you really want to take?

We (the police) do arrest 18 year old men for fondling and having sex with their 15 and 16 year old girlfriends. It may not seem right to you, but it is the law, and there are "vertical prosecution" units in many of the larger counties that deal with nothing but these sorts of sex crimes. Even in my small county we have a DA investgator that does nothing but prosecute juvenile sex crimes - including unlawful intercourse (aka statutory rape).

I went to a small private school, very small my graduating class only had 56 students. Word spreads easy in small schools. It's only a matter of time until a teacher finds out. And if they do, they might be able to kick you out of the school, maybe even her. So becareful and keep hands to just holding hands until shes 18 or older.

the right decisions..
I have no jail record and I don't have to record myself on any register... but I did have some fun...
