What is the name of your state?PA
if two divorced people own a house together and one wants to sell, what is the procedure for that? not sure what the other party wants. the party that wants to sell has been paying the mortgage for the most part, does that affect the split of the profit on the home? is a lawyer necessary? the second party is likely to be hostile, even if they are willing to sell. thanks for any help

Partition.

It probably won't impact the split of the profit on the house -- but generally, if one side or the other has been paying the majority or all of the mortgage payments, and can prove it, then that party will be reimbursed for the principal (not interest) paid prior to dividing the profits. Same goes for downpayment, and any improvements (but not repairs) made to the house.

is a lawyer necessary?
Necessary? No, you can file yourself. But it is generally a very, very good idea, especially if the other side is hostile, and especially if the other side has their own lawyer...
