My daughter has several issues going on and asked me what her rights were! It told her I would look into it! First of all she is divorced, has three children 17, 15 & 13. She has 50/50 custody. The two oldest have moved in with her and her fiance their father consented. She became pregant with this man that she is NOT married to. He has a bad drinking problem and it has been an issue. She was even considering not giving the baby his name! She has been on medicaid and they paid for the birth of this new baby. She delivered 5/21/05. Her fiance was there, all seemed fine. When the birth certificate time came he was very aggressive and insisted she put his name as he was the father. He made a big fuss with everyone. She gave the baby his name. It is a boy. She is back home now, living with this man and he is now telling her she is just in a hotel and he wants her out....he wants nothing to do with her! This has come from nowhere except he hasn't been drinking so maybe this is his issue. Anyway, she doesn't have a job, she is nursing, has her two oldest children living with her and is not sure of her custody rights with this new baby. She is afraid he will try to take this baby away from her. She doesn't get child support for the other children either from her ex as she settled for $1200 a month alimony. Her emotional state was not such that she felt she could fight that so settled for alimony.
This man she is with now owns his home, what rights does she have? Can she leave him and take the baby with her (she nurses)? Can she request child support from him even though they are not married. Any help you can offer would be appreciated.

yes she can leave and take the baby with her

has paternity been established that proves hes the father? untill then, he has no rights to the child. even if it does prove hes the father, unless your daughter is proven unfit, theres no judge thats going to give him sole custody of a baby. if paternity establishes he is the father, she can go for custody, and be entitled to child support, which he will have to pay wether he wants to or not, hes obligated to support his child. since he wons the home theyre living in, he can kick her out if he chooses. that wont relieve him of his obligations however. your daughter can leave and take the baby, because untill paternity is established, he has no rights, and cant force her to leave the baby with him

Paternity has been established though a special blood test that was taken after her amneosenthisis (?). They found some kind of problem and requested this special blood test and the doctor said according to the results there was no doubt he was the father.

Because he does own the house he lives in, he can kick her out? She has no place to go with a baby and no money. Doesn't FL have some kind of a law to protect a mother with a baby? She has no money to even go after him for support, do you know if there are any lawyers in the Orlando area that would do this for free? Any organization that might be of help?

im sorry i cane help more

pehaps she can try legal aid, thats about the only thing i can tell you. im not sure about florida laws, since im in new york. if legal aid cant help, she may have to borrow the money for a lawyer. he is obligated to support this child, she didnt make the baby by herself. she also needs to get support for her other kids, 1200 a month isnt very much for 3 growing kids. perhaps she can move in with you(if you have room for all of them) untill she can get back on her feet.im sorry i cant be of more help, since im unfamillar with florida laws. god bless you your daughter and grandchildren, and please let us know how it works out!

Besides that, she's also a drain on society's Welfare system.

the father should support his kid

she wouldnt be in this situation if the father(and boy would i like to call him something else, but i wont) would live up to his responsibilty and pay child support like hes supposed to.hes not a father hes a freakin sperm donor! there, i said it, thats the nicest thing i can say about him without getting in trouble here

How do you know what she is? It sounds to me like she was in love with this man if she was engaged to him. Just because the relationship didn't work out doesn't mean that she is a "skank", as you so eloquently put it. Why not try to be helpful instead of posting opinions that have no basis.

Well, let's see . . .

Gramme said - -

7. Then Gramme said in her second post, "They found some kind of problem (with the baby)." How much would you like to bet that the "problem" is drug or alcohol related?


Pretty much says "skank" to me!

Poor choices in life usually emanate from the parents' upbringing of their children, and Gramme is to blame. Now, it's all getting passed down to a new generation. How lovely.

Great news I just got my crystal ball back from the shop so I am trying it out this morning :)

Mom has custody of the 17 & 15 yo but not the 13 yo and is not getting child support but alimony instead, Hummmmmmm, these children have different fathers and that is the reason for this arrangement and why Mom doesn't have custody of the 13 yo.

Mom is not married because alimony would stop and she would have to go to work.

Amnio was done because of suspected substance abuse, possibly alcohol. Why is she afraid of the father with an alcohol problem getting cutsody?
Maybe Mom has problems too and just telling Gamme what she wants to hear?

Since paternity is established, why hasn't she filed for child support and left unless she is afraid of losing this child also?

Sometimes mom is called a Skank and there may be reasons for this.
