I recently was served court papers to go to court for a Modification of Support from my ex-husband.In 1999 we agreed to me paying $20.00 a week and he'll provide the health insurance.I got remarried in 2004 and my husband brought a house.Today I'm current with my payments and don't understand why he's trying to do this.I want to know if they would consider my husbands income and increase my payments.I work but part time and only gross maybe $10,000.00 but the payments come out of my checks weekly.

Please Help Me

They won't take your husband's income into consideration. Most states review cs every three yrs, so you're overdue anyway. $20 doesn't even begin to pay for what a child needs.

It's likely the new child support award is going too made according to a 40 hour work week (not p/t). You are probably going to see an increase. I suggest that if you aren't entitled to the tax benefit that you request it for every year (probably get every other). If not already built into your state guidelines, request that the cp be responsible for the first 250 of medical expenses per year. (For anyone reading this, folks, read your state guidelines, not the crappola that's on the support enforcement website, dig into the code, most states build in automatic support deductions you have to do your research!) You can also request that child support be fully abated if you have the child in your custody for a period of time over...say 10 plus days or so (good chunk of change if you have custodial time in the summer). There is no guarantee that you will be awarded any of your motions but you won’t know unless you make the request(s).

Most states have abandoned the abatement for extended visitation in favor of an overall parenting time credit that is evenly spread over the entire year....so that part might be a waste time. If OP's calculation included that it would show on the CS worksheet.

For six years you've been paying a measley $20/week. He the kids deserve more. Would you have accepted that tiny amount if he'd been paying that little.

Also, at $20/week, I doubt a judge will give you the right to claim the kids on your taxes.
