We are trying to settle a living trust and the other side does not seem to want to compromise. One Co-Trustee lived in the house, refused us access and will not pay rent, and she wants to be considered a caregiver in lieu of rent, but the person she would have been caring for was a patient in a nursing home the whole time. Can I sue her in small claims court and get my rent?
Also, the same person and her sibling embezzled $9-10k from the estate account using a POA which required all 4 Co-Trustees to sign. I know the bank made an error, too, but those 2 Co-Trustees knew that it took all 4! Can I sue in Small Claims for my part of the embezzled money?

Who owns the house--an individual or the trust? Does the trust or will specify who gets ownership of the house?

You need to check with small claims court to find out what their financial limits for damages, but you certainly do have a case.

The trust owned the house. We finally managed to get it sold and the money is still in escrow account since May 2005. We cannot seem to get them to discuss disbursing the funds, one is on SSI and does not want the taxpayer to share with her is what we are asuming.
