My brother just passed away at the age of 54. We are not able to locate a will. The estate is less than $100,000.00. He has 2 daughters. We understand that all goes to the girls, but since they live at the opposite end of the state my father, stepmother, my other brother, my Aunt, my husband and myself had to pack his belongings and put into storage, take care of crematory arrangements, etc. Quite a bit of expenses have taken place. We don't dispute the legalities of who his estate belongs to, we just want reembursement. We attempted to get paperwork from the courthouse in the city in which he resided and they said they have no idea as to what type of paperwork is needed to handle this. Any suggestions without having going through an attorney, which will be another expense we may not get reembursed for.

Check your state statutes for the amount to file probate for a small/family administration. You'll also find intestate (without will) statutes. Whoever volunteers to be the personal representative/executor needs to take an original copy of the death certificate to the probate division of the courthouse where your brother resided and open probate.

His final expenses can be reimbursed to whoever paid them. After any and all other final bills are paid, the rest will go to his children.

An Atty hired to do this work for you would be paid from the Estate not you personally. Since neither of the girls are willing to come and see to THEIR estate then hire the Atty so no impropiety can ever be suggested against you. Since it sound like a lot of what you are talking about sounds like "per hour" work performed the Atty can help you establish a rate for that too.

Also you want to settle that storage issue pretty quickly if it is somewhere where a monthly rent is accessed and in one of your names instead of the Estate or daughters.

I guess what I am saying is that in this situation make sure all the i's are dotted and t's crossed because money does strange things to relatives, yes even the closest one.
