What is the name of your state?nSeller claims he will take me to court for leaving one of his competitors names and phone numbers in his feedback. also gave competitors price.. is this illegal? He is in NY I am in NJ. Would I have to go to court?

Ebay can eliminate the feedback post if asked to. There is a procedure for that, and I'm surprised they even let the post remain. Your seller has no claim to make against you. What are his damages? What is he going to tell the court...that you stated a fact and he didn't like it? He cannot claim slander/libel unless you called him a child molesting thief, or something that not only is a lie, but also causes him provable harm. If he has a beef it is with Ebay for leaving the post on the forum.

That's like saying he could sue you for putting ad ad in the yellow pages or newspaper with lower prices or a better guarantee. And of course he has exact figures showing precisely how much business he has "lost" since your feedback appeared? Yeah, right.

I'm not sure where's he'd even file. This isn't about a transaction per se. You can threaten a counterclaim for him filing a frivolous suit. His beef is with Ebay for leaving it there if it violates their policies and he asked to have it removed. You just posted a fact.

thanks Dallas. He also claims to be friends with the da and the judge, If he did get them to look at the case could I suggest change of venue? Alsoclaims his cousin is a lawyer with NY State Supreme Court.. I feel he is harassing me..

NY randomly assigns its lawsuits to judges. They don't get to pick and choose which ones they want. The DA has nothing to do with this as its (barely) a civil matter, not criminal, and there is no such thing as a "lawyer with the NY State Supreme Court", the court doesn't have lawyers. Before you tell him to go to hell, mention that you're the Grand Poobah of Duodenum and you know the King of Siam. Maybe he'll get the point.

How do I sue ebay?!?

I recently spent over $750.00 on EBay on a notebook computer that I never recieved. I should've known and backed off of it when the payment method was a Cachier's Check, but I didn't.

I never recieved the item, and EBay is only going to give me UP TO $200.00 - a $25.00 processing fee.

I'd like to know how I would go about getting the rest of my money back and if there is any way of starting a lawsuit up against EBay to make sure they actually PROTECT their BUYERS, instead of protecting the people who rip them off.

I still have all of the emails she sent me and all of the reciepts from the Cashier's Check and the Overnight I paid for the payment to get there.

In addition, my bank, Bank of America, told me that once the check was cashed, there is nothing they can do. So apparrently, there is no way to get my money back, atleast at the moment.

Please let me know what I can do here. It seems everyone is out to protect the people that are out to harm us. >,<;

You need to start your own thread. Then someone may answer your question. This is considered hijacking and it's very rude.
