NJ's threat to destroy my family

This posting involves the State of NJ

My wife (of 31 years) and I are the adoptive parents of a 15 year old child suffering from the spectrium of Autism. We have two other birth children at home. Our adoptive son became violent and a threat to both himself, the remainder of the family and others.

As a result, our adoptive son is in a residential placement (in Delaware because NJ had no appropriate facility), and the non-educational portion is paid for by the NJ Div. of Youth & Family Services (DYFS). We have been paying token child support to the State during this placement, but recently received a proposed increase of more than 820% to almost $1200 per month. If this order stands, we are likely to loose our home (on a 1100 sq ft home we have a $2300 a month mortgage), and will be hard pressed to provide for our two other children.

We have recently applied for SSI for our son, but that application is still pending.

I understand that the State is out to recover some of its costs, but in the process appears poised to economically and psycologically destroy me and my family. I don't understand how this is in the best intrest of the children nor society as a whole.

I would like to hear how others have coped with this type of issue since it is beyond my comprehension that my family and I could be the only ones faced with this sort of problem.

Please understand there is no divorce, seperation, or child abuse involved here - its purely a matter of a disabled child in residential placement because he represents a threat to others.

Okay, BB, where are you on this one? Hmm, don't know????? Figures. Whenever there is a really important, complicated legal question, you don't answer.

Those with SSI experience, would this help? And how fast could it be processed to protect this family?

Oh please. Instead of being an idiot, why not spend some time researching the answer yourself?

The child was discharged from a pediatric Psych unit directly to the out of state residential placement. There was a judge involved in forcing the identification of a placement, but as I understand it, the placement is voluntary. I have been lead to believe that should I withdraw my approval for the placement, DYFS would likely seek custody of all three of my children due to the "hazard" I would have created by bring him home.

Have you consulted with a family law attorney regarding options for the adopted child?

To be honest, you most likely, based on the statues of New Jersey, WILL be assessed child support to help defray the costs. However, since the court ordered the placement it's unlikely that the entire cost could be offset by child support.

I would strongly suggest you ask the court to appoint a GAL for the child and seek your own legal counsel immediately.

The larger question here is what can DYFS do if you bring the child home and that is what you need to discuss with your own attorney immediately.

Maybe, because I'm too close to the issue such that I have misunderstood your post in reply, but I hope you are not suggesting that I haven't spent a great deal of time looking or reasonable answers to this issue.

Indeed I have spoken to two attorneys, but the pri**** thrust has been how to deal with the unreasonable amounts that have been proposed in child support. I am not familiar with the term GAL, but I am guessing it is some kind of champion or legal representative for my adoptive son.

I thank you for your advise and will look for such legal counsel tomorrow.

New Jersey is attempting to recoup their costs. However, they still must follow the state guidelines (within reason).

THAT is the reason I told you to consult IMMEDIALY with an attorney. You have your mind elsewhere and are no equipped ot handle this on your own.

It was in response to SingleMom's snide post about BB. Hence why I quoted HER post, and not yours. :rolleyes:
