What is the name of your state? Vermont. My brother and I were discussing settlements on sexual harassment cases. He claims it's a joke that some of these harassment cases get so much money in settlements. I argued that it depends on the size of company for punative damages. He said that is bull...so to speak. He claims that it should be the injury sustained in a civil action, and that harassment unless it's been a physical assault should not get large settlements. I see his point, and wonder why in some sexual harassment cases there are settlements in the millions, while other cases which seem worse in nature are so small? thanks faith

Tell him also that there is no right or wrong answer to such a cause of action. EVERY case and it's attending award, depends on the exact and specific facts of the harassment and it's history of corrections.

Yes, an off-color joke once is not on the same level as a company with a pervasive history of ignoring sexual harassment complaints and has a class action suit filed against it.

And neither is a sexual assault on the same level as a game of oggling by the boss, both of which are sexual harassment but on different compensatory levels.

And that is why there IS no right answer.

So I guess I was the one wrong here. I thought settlement sizes were based upon the size of the company. The bigger the company the bigger the settlement thinking punative damages were like a sanction fine. So facts be known....size doesnt matter. ( Ill sit here and wait for the jokes on that one...:) ). Thanks Faith
