What is the name of your state? VT

Why is it the company gets off on harassment if they follow procedures? What about the impact it has had on the victim emotionally and physically? It's like yes you were harassed, but, since we have policies in place and stopped it from happening (even though most of the time the employee is now treated like the plague), we are no longer at fault for your being victimized. So what good is the law in place to protect your rights if the punishment for it happening is forgiven??? It is not uncommon for the person being harassed to have coping issues and depression afterwards. How are they protected in that area??? And most of the time the person doing the harassment has their hands slapped for it. Shouldn't the company still be liable for the harassment that took place? Aren't the policies there so all employees understand it is "illegal"?

Let me turn that back on you. If an employer is going to be held liable for the harassment regardless of whether they stop it or not, what's their incentive to do anything about it?

There is no possible way an employer can have 100% control of everything their employees do every minute.

The short answer is: "because that was the ruling of the Supreme Court." Before that ruling, there had been considerable debate over whether employers could be held liable for this type of environmental sexual harassment. Basically the Court told employers they would be held liable if they didn't have procedures in place to allow employees to complain about unwelcome behavior of a sexual nature, didn't properly address the complaints when they arose, and didn't end any harassment found.

In theory, if you immediately complain when the first unwelcome comment is made and the company acts, you won't have the opportunity to feel victimized. It's really not the company's fault that you suffered in silence.

You took the world's right out of my mouth. My investigation was concluded today. According to HR, since they moved me to another supervisor, the "harassment" has stopped. BS! My days are numbered in this company because I complained. HR isn't going to protect me. They are protecting HIM! Protecting the harasser instead of the victim. As I mentioned in my previous post, these sexual harassment laws are a joke! I got abused verbally and he improper touched me, yet all he probably gets is a verbal warning. WTF? It's definitely a man's world. :mad: Women's liberal movement? Yeah, not when there's an "old boys' network" running the place.

So tell me if Ive got this right. So harassment will be tolerated as long as the company follows procedures of the policies in place. Because that is what it comes down to. Its like saying well, look you got raped, get over it, we know it was an ordeal at teh time, but we talked to the rapist and it will never happen again. Oh and don't let this effect your job or we may have to let you go because of this. So suck it up.
