We are an end unit townhome that owns 10 feet of property that runs from front to back along the side of our home. According to the condo documents this is called an easement with the right of the other unit owners to use to access the common elements that run accross the back of each unit (boat docks)from one end to the other. It is used to give other unit owners access for services such as pool cleaning or boat repairs without having to actually be home for the service provider to access their property and provide the service. We have the responsibility to repair & maintain this part of our property - who has the liability? Is this covered by the HOA's liability insurance, or are we liable since this is our private property? Is isn't stated in the condo documentation - how can we find out in order to protect our assets?
