What is the name of your state? mass
My children have not visited their father for over a year and have not spoke to him since April 2005 they told him and he told them he disowned them. He has now sent a contempt order on me. My children do not want to visit at all and are petrified of him. My children do not want to go do to his behavior with them. Please help!!!

Presumably there is a court order for visitation. Has he tried to exercise his time since April 2005?

My response:

You know what? The father is absolutely correct. Instead of being a "parent," you allowed your children to make a serious decision that only an adult should make, and now you're going to be held in Contempt of Court for your purposeful "error."

You don't listen to children. If there's a Visitation Order, you do whatever it takes to shove them out the door to uphold YOUR end of the Visitation Order. If there was a Visitation problem, you should have brought the matter to the court's attention. It wasn't up to the children, or you, to make a decision like this without court approval. Now, you're in hot soup.

Bring to court the following:

1. Lot's of money to pay a fine; and/or,

2. A change of underwear for your weekend in jail.

no he has not. He was the parent who disowned them and sent letters back that they sent to their Grandmother and cousins. He has never phoned me to speak to me still

And you can prove that you have had the children waiting each time, right?

What did the original visitation order say? Was there a specific schedule or was it "as agreed"?

In any case, its going to be difficult for him to prove contempt if he hasn't attempted to exercise his visitation. If the order was "as agreed", it will be even more difficult for him to prove contempt.

You were however, wrong to allow the children to make decisions regarding visitation. If there are truly serious problems with visitation, you should have addressed that in court....as you must address it now.

You see, that's the difference between you - a schmuck - and me - an attorney. That was one of the dumbest statements! If you can't figure out how he can prove his visitation and her contempt, WITHOUT "DIFFICULTY," then you're a bigger schmuck than I had ever thought.

So, since I'm not too thrilled with what the OP is doing to her child by allowing the child to make the "decision," and not in any mood to help such a recalcitrant, how about you justifying your remark?
