Damage caused by wrecker service

My vehicle was towed last month because it was parked on a private lot. The wrecker service loaded the car on a flatbed from the rear. When I picked up the vehicle, I paid all fees and noticed they had damaged it.

The front end was scraped up and is cracked. I took photos of the vehicle before I left the lot and filed a police report.

The owner of the wrecker service will neither deny or admit to the damage, but gave me a number to call to make a claim. Someone at that number then gave me another phone number and insurance policy number to make the claim. The insurance company then called me and said they don't insure the truck that did the tow.

So now the owner wants her "body shop" guy to do the work. I have 3 different estimates ranging from $470 to $750 to fix.

If the truck was not insured at the time she towed my car and caused damages who could I report this to?

Also how can I get her to cover the damages correctly?

I really want the car fixed because my husband drives it to work and to transport our kids. We live kind of far from his work (he drives it about 70 mi per day) and the crack has already started to get bigger.

Call the police, reference the original report, and tell them about it.

Have your insurance company repair your vehicle. You are responsible to mitigate your damages, and it doesn't appear that you are doing that, if the crack is getting bigger.

I really don't want to make a claim with my insurance and have to pay the deductible. I've discussed it with them already and they said if they felt they could get the money out of these folks they would go after them after I've made the claim. Only then would I get reimbursed for the deduct.

I don't have $500 lying around. That's about what it would cost out of pocket anyway.

I'm going to try one last time with the owner before calling the police and insurance.

The damage that was done would cost the same with the crack or whether is broken in half, its a factory bolt on piece that either way will have to be replaced.
