1. Can you be wage garnished for a credit card debt judgment in the State of Ohio? And, if so......

2. When a credit card debt judgment is "assigned" in Ohio, is the new assignee able to wage garnish under their own name, or do they have to do it under the original creditor's name? Or, does it depend on what the differing assignment laws are depending on which court the judgement was received?

Yes.

If they are an assignee of all right, title and interest in the judgment, they act in their own name. If they are acting as assignee for purposes of collection, they would be likely to act in the creditor's name. You could also craft an assignment whereby the assignor conveyed the right for the assignee to act in the assignee's name without a full conveyance of title and interest and with a right of reclamation. So the answer is, it depends on how you draft the assignment and whether it's irrevocable. If that isn't sufficient, you need to be more specific about what you're trying to get at.
