In the year 2000 my fiance was named the father of a child. My fiance believed with all of his heart that he was the child's biological father and therefore he did not contest to the paternity when the mother of the child and the Child Support Recovery Unit ordered him to pay child support and delinquent child support as well. The mother soon began to deny him any visitation of the child and he then requested a paternity test which she refused to perform. My fiance then hired an attorney and had the mother ordered with a paternity test and in the year 2001 found that he was not the biological father of the child. The child support order was then terminated but the Child Support Recovery Unit refused to order the mother to reimburse him for the monies that she had collected for child support, so he decided to sue her in Small Claims court. The mother did not appear for the hearing due to the fact that she was pregnant once again and a default judgment was entered against her for $2,500.00, and she did not appeal within the 20 days that she was allowed. Well, our questions now are....
- Now after 5 months the mother said that she is going to attempt to appeal to the judgment because she was on bed rest at the time of the hearing and that is why she could not appear, can she do this?
- She is not employed and does not own any property that we know of, is there any other way to collect this judgment that we have against her?
- Since she refuses to pay the judgment, can we have the amount added to her credit report?
- What can we do if she buys property and transfers it into another persons name?
- She is planning to get married soon, can her soon to be husband be responsible for this judgment also?
Any help and advice would be much appreciated!

Only thing I can offer to you is this , If she marries again some day some ones going to do a credit check for a loan like a house or a car and it will show up and could interfere with them gettting the loan or better yet if they succeed in buying a home and go to sell it theyre gonna have to settle it that judgement when home is sold , Or maybe you can sell the judgement to a judgement collection company .

So the judgment debt will automatically be added onto her credit report without our request? I have also heard that if she decides to buy a home and it is her first home then we cannot do anything with it, is that true? Thanks, Shannon:)
