small landscape business had a verbal contract with an HOA for a landscape renovation to common areas. contractor told HOA their buget wasnt feasible, but HOA moved forward anyways. contractor kept in touch with HOA throughout project verbally and through text messages and email. HOA provided a down payment prior to project. once project was nearly complete contactor sends invoice, HOA pays part of invoice and says balance will be paid upon completion of job. HOA loved work done, very please. suddenly HOA refuses to pay balance on invoice, says they did not approve such a high price and also says work done is not sufficent. contractor continues to send request for payment, but nothing. over two months later, contractor contacts HOA and says they will file a claim/lien if balance is not paid on work completed. contractor gets letter from HOA attourney stating their claim is fradulent under KRS376, there is no written documentaton, and are obligated for repayments and overpayments of 2000 for deficient and incompetent work, violated kentucky consumer protection act and responsible for HOA attourney fees of 1000.
