One last thing ... can I (plaintiff) call the defendant to the stand for questioning or can I only hope/wait for him to take the stand voluntarily (after which I can cross-examine)?

The other side will have a lawyer.

The defendant does not have to testify.

This is not a criminal proceeding. He can call the defendant as a hostile witness. What the defendant answers is a different story.
