Neighbor's pine tree hit by lightning 6 yrs ago, partially decayed (about 1/2 way through) and structurally unsound (per professional tree companies). 2 wks ago during storm top 30 ft. portion breaks off (55 ft. of tree still standing), falls onto our driveway crushing new truck. Neighbor's homeowner's insurance says too bad...up to your auto liability policy. Isn't there some liability since the neighbors should have taken care of this tree to begin with? They have record of previous insurance co. paying them for repair to roof due to lightning strike 6 yrs ago. Go after neighbors (who we like!) or their insurance co? Why should I be stuck with a repaired truck with greatly diminished value and possible structural defects, and out of pocket for my deductible? Grrr.
