I am confused by the Residential Landlord Tenant Act. I have a verbal agreement with my landlord. I have lived here for 15 months with no problems. He has given me notice that i have to be out in about 10 days with no reason why. Considering that i have done nothing wrong and he hasn't given me a reason, will he be able to legally evict me after 10 days or does he have to give me 30 days notice?

In the Arizona Residential Landlord Act in Article 33-341 it states that only 10 days notice is needed. I am getting conflicting advice from lawyers. One lawyer says that since it is just a verbal agreement that I am just an "at will guest" and the landlord doesn't need to give any notice or reason. Another lawyer says that he has to give me 30 days because it is considered month to month and there have been no violations. Does anybody know the truth? It really worries me when lawyers are even conflicting each other.

33-1375. Periodic tenancy; hold-over remedies
A. The landlord or the tenant may terminate a week-to-week tenancy by a written notice given to the other at least ten days prior to the termination date specified in the notice.

B. The landlord or the tenant may terminate a month-to-month tenancy by a written notice given to the other at least thirty days prior to the periodic rental date specified in the notice.

You have to look at the previous lease you had with the LL... Chances are it is a year long lease that turns to a month-to-month lease at the termination of the lease...

IF that is the case, you are a month-to-month tenant and must be given 30-days notice... The only times I have ever heard of a week-to-week lease is for passer-bys...

It will be clearly written in the lease. I think also that in AZ if no lease is written, than it automatically creates a month-to-month lease... Will need to verify though...
