What is the name of your state? mass.
one day i get a picture in the mail of a ten year old boy and a phone number.
i call it meet the mom take a dna test and this is my son . the mom knew from day one
and never told me. can i sue her for stealing ten years of his life from me

That would be nice, wouldn't it? Legally, I don't know the answer to that question, but I'm pretty sure the answer is no, you can't. What you can and should do, right away, is petition the court for visitation rights (you may have to start out slowly, after all, you are a stranger to this child, through no fault of your own). Then, start building a relationship with your son, and cherish every moment you DO have with him. You can't get back the last 10 years, and that is sad, but you CAN be a part of his life now, and in the future.

it matters because IF she did and OP IS the father HE will most likely be the one paying back the state...mitigating circumstances or not

That hardly seems fair or likely. If there is no knowledge, how could he be held responsible for it? Seriously, the TX court system is not very good at following the letter of the law.
Is that the reason that BelizeBreeze asked if she had applied for assistance? Because it seems to me that SHE would be the one responsible if she had not pursued support. Knowing she could have gotten it.

Nobody cares that you don't think it "seems fair or likely." If the guy is the father, he's on the hook for the State Aid - - every penny!

So, please. Stop responding. Nobody wants or needs to know what you "think." Either answer with the law, or STOP responding!

What does Texas have to do with ANYTHING? Besides, dad repaying government benefits paid for the child IS the letter of the law in Texas.

she knew all the time

she has know from day one that he was mine she was involved with someone at the time.
when she found out she was with child she stoped visiting me. and told me it was his. she loved him and saw herself with him forever. i dont believe she was ever on food stamps or any other assistance.the child has known he was mine for 2-3 years now and that is why she contacted me

If she was also with someone else at the time, then how could she have known that it was your child? It could have easily been the child of either one of you.

So basically your saying you buried your head in the sand, pretended there was no way this was your child, and now you want to be all indignant and sue 10 years later. You're quite the prize. :D

It sounds like both of the POSSIBLE fathers are real winners! :rolleyes:

So now that you know that you have a 10 year old child out there, instead of trying to make up for lost time, which it sounds like YOU are just as responsible as MOM was for that, you would rather sue the mother? If you were to win (which you WON'T), you would only be hurting the CHILD by taking money out of the household that is needed to take care of the child's needs. Great way to put the child FIRST!

Yes, people want to know what other people think, they don't want bad want to be lawyers like you mouthing off the cuff about random things.
The great thing about the law is that it can be changed through one voice, so go ahead and attack away..
What I did was make a comment, I didn't profess to be any kind of professional, I simply asked how could a person be made to pay for something if they had no knowledge of the existence of the issue.
Seems to me that you have problems reading...
