What is the name of your state? new york

i heard from someone that if i stay in the marriage for 10 years, there is a greater chance for me to get something from my husband in case we divorce? is this true? my marriage is on the rocks and my husband has been emotionally absing me. i am getting tired of it but am staying for my daughter only.

what are the other factors to take into consideration?

There are three areas of finances within a divorce.

Property settlement: No matter how long someone is married, each spouse is entitled to a share of the marital property, and responsible for a share of the marital debt.

Child support: The parent with primary custody would receive child support.

Spousal support: This is where the 10 year figure could come into play. However there is a lot more than just how long you have been married that determines whether or not spousal support would have to be paid.

Typical. She doesn't want him but will take his money.

She wants to divorce the guy but have the ability to put his future earnings in her pocket rather than earn her own.

from experience the longer you stay in the marriage when you do decide to file and if you use cruel and inhumane treatment more than likely youll be screwed. The burden of proof will be on you and the it will be very hard to prove that things were soo bad because you chose to stay in the marriage, In short, the burden of proof increases the longer you stay married. Been there done that and got screwed. Now I cant get a divorce in NY.
