What is the name of your state?Alabama
I lived in Alabama about 10 years ago ( I now live in another state ) and because of hard times, I wrote some checks that I could not cover. Over the years, I had forgotten about them and never gave them another thought since I hadn't heard anything about them. Well.... after 10 years, I get a letter from the district attorney saying that I need to make good on them and that a warrant had been recently issued for my arrest. Then just today, my husband gets a telephone call stating that "due to new technology" they were able to track me down and want me to make good on the checks to keep an arrest warrant from being issued. My question is......
1). These checks were written 10 years ago..... can they now issue an arrest warrant for me?
2). Is there no statue of limitations on this matter. The checks totaled barely over $500 and now that they added all of their charges to them, the total is well over $1000.
I would appreciate it if I could get some information on the statue of limitations on this in the state of Alabama. thanks

There is no statue of limitations on owing money. Once it is owed, it is owed until you repay it.

.

My response:

Well, that's not completely true.

You see, you moved to another State after you had committed a crime. If criminals could merely move away and have no fear of prosecution, there would be many more crimes committed, and people would be moving around like crazy!

The fact is, once you moved away from Alabama (the trailer park capitol of the country), the criminal statute of limitations was "tolled" and, as the theory goes, you could be "on the hook" forever.

Pay the debt before Alabama extradites you back to stand trial for the felony you committed.

bad checks .... 10 years?

Thanks.... appreciate the input! It just seemed very strange that after hearing nothing on the matter for 10 years that, out of the blue, this pops up to haunt me. I would've thought that this would be more of a civil matter at this point, rather than a criminal one. But.... hey.... what do I know? I plan on taking care of the matter as quickly as possible now that I've been contacted. Once again, thanks for the input!

My response:

Sometimes it takes a long time to find someone . . . especially when debtors, like yourself, don't leave forwarding addresses with those you owe.

FYI
I moved from Alabama and left a forwarding address. Not to mention that I have worked steadily since I had moved. I did not move to "shirk" my responsibility, nor did I go into hiding. I simply did not think about it again since I had heard nothing. I admit that it was a stupid thing to do and plan on addressing and correcting the situation now that it has been brought back to my intention. I am a woman in my early fifties and just needed to know if they could do this after such a long period of time had passed.
You answered the question for me and I appreciate that. But for future reference..... there is no real need to be sarcastic nor condescending towards those looking for answers to their questions. It's not really helpful in the matter and actually "cheapens" the intended purpose of what I believe that this site was set up for. But once again, thanks for the input and I sincerely hope that you have a good one!
