On December 21,2000 I was given a 14 day notice to quit. Before the 14 days were up, I was served with a summons for non payment of rent, is this legal can you be given a summons before the 14 days are up? I have been back and forth to with my landlord since the end of November. I took him to court for failure to make repairs. He is well aware of why I am withholding the rent, yet he still attempts to have me served with notices. Can anyone help me.

The court issue has been ongoing since 11/30/00, and the result was that all work I had requested was completed. Then I get hpme and a constable shows up. But a little over a week prior I was given a 14 day notice to quit and the 14 days were not up when I was served on 1/4/01.

Ok so all the requested work was completed. Did you then pay all your rent and are you current? What, you are still behind. Then L has the legal right to evict you.
