You're not capable of supporting yourself, so you're automatically ineligible for emancipation. That's just not an option.

If your Mom agrees, she can sign over guardianship to a third party.

If that's what she wants, she should really come here herself.

Small piece of advice: If you're typing from your phone, do try to use a spell-checker. Your post is really hard to read.

This is a real, true, legal answer. No "stupid teenager" about it; simply legal facts.

At 16, you are not going anywhere legally unless Mom says you may. There simply IS no legal way for you to leave home at 16 unless you have parental permission or you are removed by the state. You do not qualify for emancipation and you'd have to have your mother's permission for that anyway.

If your mother says you can live somewhere else, you can. If she says you cannot, you cannot. Period. That IS the only answer.

That is the only legal answer.

I will also add some of the "shut up and deal with it and other crap" that OP doesn't want to hear. If the home is so bad, I would strongly encourage you to talk with a counselor at school or your church. Or a teacher you trust. The decisions you make in the next couple of years will affect the rest of your life and you need some mature, adult guidance.

I think you also need a visit from the reality fairy. It is not easy to raise a teenager after losing a spouse and your mother is undoubtedly doing the best that she can under the circumstances. You don't know why she isn't working - she may not be able to. Or maybe she has tried to get a job and can't. Or any number of other reasons. But, in the end, there's a roof over your head, clothes on your back, and food in your belly, so a little bit of gratitude wouldn't kill you. Maybe she hasn't bought you the latest toys or a shiny, new car, but she is supporting you.

Living on your own would be very expensive. If you really think you'd be capable of doing that, why not use some of that money to improve things at home rather than trying to flee? Of course, that's hypothetical - there's absolutely no way that at 16 you could be earning enough to live by yourself while staying in school.
