What is the name of your state (only U.S. law)? alabama
I have a 16 yr old son who previously got in trouble for having marijuanna at school. The school didnt' press charges but he was sent to an alternative school for a period of time. Now that he has returned to school, students are just randomly going to the principal and suggesting that he has marijuanna again. The school searched him and didn't find anything but still suspended him because of his past record. My question is, are they able to do this and what can I do to keep my son enrolled in school?

Unfortunately your son's reputation is going to follow him at this school. If they did not find any drugs on him, then why did they suspend him?

They suspended him for "Soliciting to sale marijuana" and this is because some random girl told the principal this and he believed her. What is your take on this? Don't they need proof? Do you think I have a lawsuit?

No you don't have a lawsuit here. If the school believes he is a danger to the other students, they have a right to suspend him.

You son did this to himself. He now has to walk a VERY thin line ~ doesn't look like he's doing a very good job of it.

I'd take the rose-colored glasses off mom.

So... I definitely hear what everyone is saying. No, my son is not perfect and he has reformed from the last incident. He brought his grades up and was doing what he was supposed to do. The thing is, people knew he was on probation with the school and they used this against him to get him suspended. To be honest, I think it might be an ex-girlfriend who started the whole thing. How can they single him out without proof and suspend him knowing this will affect his academic standing as well as his reputation?

His reputation and academic standing are already in the gutter. He did that to himself. His time at the alternative school will not be overlooked.

Make an appointment with the principal, and tell him EXACTLY THAT -

"Sir, my son is trying to get past the problems that occurred last year. He is now on the right path. I think another student may have told you something false about my son. I'd like you to please reinstate him back in school until you can show me proof of his wrongdoing. My son will, of course, allow you to search him or his possessions at any time, to prove he is clean and wants to be in school."

Seems like after enough time of him coming up clean, they will drop it, and the ex girlie's game won't work.

Make sure son stays clean.
