What is the name of your state (only U.S. law)? Georgia
HELP!! please read all of it...I really need your help

I live in Georgia and my boyfriend is 20 years and my parents are completely fine with it. One problem, he's in the army and he's scared to death of going to leavinworth. It's some kind of jail for people that have broken the law that are in the army or any military branch. Anyways, he's scared to death of going there, so he doesn't want to tell ANYONE! not even my parents...But they love him, they think he is so sweet and I know they wouldn't give a crap if I dated him. Specially since I dated someone who was 20 when I was 13. It's literally my 16th birthday today...I thought it was completely legal as long as I'm at least 15 and my parents are fine with it...I mean we haven't had sex and we don't plan on it...He doesn't want to, and I don't want to...We have kissed, but that's fine isn't it? As long as we don't have sex I thought it was fine. But we just got in a fight outside because I want to tell my parents...I never kept anything from them...Anyways, I need to know. Please help...I really like this guy and I want to tell the world I'm dating him because that's how much I'm proud of being able to call myself his girlfriend. So I just need to know...I mean my older brother (24 yrs old) told me that I'm sixteen, I can legally have sex with him if I wanted to, but he said if I did that he'd kick a$$ so yeah he said I can legally have sex with someone over 18 and legally go out with them too...I'm not so sure about the sex, but I'm pretty sure about dating...Please help me

There are two separate issues here: when (and whom) you can date, and when you can have sex. They are not the same under the law.

As far as the law is concerned, as long as you are not having sex or sexual contact (which is NOT limited to sexual intercourse) you may date anyone your parents give you permission to date. There are no laws in any state regarding dating. If your parents are fine with it and you do not have sexual contact (again, this is NOT limited to intercourse) the law is not going to interfere.

The next paragraph deals with the laws of Georgia. It does NOT deal with the rules of the US Army.

At 16, you are considered old enough to consent to sex. What that means is that if you and your boyfriend have sex after you turn 16, the state will not put him in jail for statutory rape. It does not, however, mean that there are no charges at all that can be placed against him and it also does not mean that your parents are compelled to allow you to have sex. If your parents are fine with him dating you but NOT fine with your having sex with him, your parents can make illegal what the law says is legal. There is no statue you can wave under your parents' nose and say, Now you have to let me do anything I want with him, because if your parents say no, it's no. Until you are 18, your parents get to make the final rules and they can say no even if the law says yes. The law may not be interested in jailing him any more, but they also will NEVER and I do mean NEVER force your parents to allow you to do something or see someone that they do not want you to see. The law is not going to take away your parents' right to parent you until your 18th birthday, whatever the criminal statutes may say.

I do not know what the US Army has to say about one of their soldiers dating an underage girl, but they are a law unto themselves and in the event that it violates their laws, he can go to Leavenworth even if the state of Georgia is not interested. I'm sure there is someone here who will be able to say.

According to the Uniform Code Of Millitary Justice it is illegal to date anyone under the age of 18. Heard that Directly from a Drill Sergeant. So technicaly he could get in trouble.

On a Personal note I see nothing wrong with it but what the UCMJ says goes in their book.
