What is the name of your state (only U.S. law)? Idaho. My son's 19, girlfriend is 17 & pregnant. She wants to live w/us in california, her parents arent letting her leave home. What rights does she & the teen father have in this situation?

Her parents have the right to keep her at home right up until she's 18. Without their permission, she's not going anywhere.

Your son should, once the baby is born, file to establish paternity, visitation/custody and child support.

The father has no rights until kiddo is born. Mom of baby can send Baby to live with you, but if her parents say no shes not going anywhere.


that might just be a serious disaster anyway.

How did a young man in CA impregnate a kid in Idaho. ??

well he lived in Idaho @ the time, in fact he lived w/her & parents from the time he was 18, therefore her parents knew they were having sex...theyve dated 2 yrs. Now all of a sudden the mother is pretending to care. Mother is emotionally & somewhat physically abusive, thus the reason for wanting her w/us. Son is working @ a very good job in Cali now & wants to provide for her & child. I wondered if she was emancipated now that shes pregnant

No, she is not emancipated.

If she is being abused, and you know about it, have you called CPS?

She has the right to live exactly where her parents tell her to live until she is 18 and not one minute sooner.

There is NO state where pregnancy provides legal emancipation. Medical emancipation, yes - she, with the help of her doctor, can make her own decisions about her health care and that of the baby. But legal emancipation? Not hardly. Getting pregnant pretty much proves that she needs MORE supervision, not less. Ain't no judge in the country who's going to emancipate a minor so she can go live with the LEGAL ADULT who impregnated her.

BTW, the age of consent in both California and Idaho is 18, so your son might want to consider talking to an attorney as regardless of which state this happened in, he has committed a crime.

Well Ive known about emotional, but no one listens to that. I just found out that she shoved her so ya, I plan to contact attorney & find out what I need to do now, if its enough for cps or not. I also have to tread lightly w/this woman if Im to have any chance of convincing her to let her go. I see it as basically just a power thing w/her cuz she hasnt cared up to this point

And to CBG, you might wanna look again...legal age of consent in Idaho is 16 w/ parental consent & her parents fully consented when they let him move in & knew they were having sex...he's dated her since 16 so he was a minor also, moved in w/em @ 18 against my wishes but he was 18 so had no choice.

I don't think you understand what you're being told.

You have no standing to do anything - this is really not your business, though I understand your concern.

Again, if the child is being abused, the child should call 911 and/or CPS.

(Then again, I'm getting the distinct impression that you're actually one of the two kids involved...)

tread lightly? a pregnant CHILD was pushed by an adult and you want to TREAD LIGHTLY?

you've sent your perverted adult to live with a child. got a MINOR child pregnant. but you don't want report anything because it won't get you what you want. have you completely lost your mind???? :mad: your grandchild is getting tossed around in utereo and you do nothing??

you don't determine what is enough for CPS. that's CPS's job. you don't have the common sense to deal with this issue. involve someone who does!

mom has the legal right to demand her child live in her home. of course she should buck at the idea of sending her already pregnant child to live with a statuatory rapist! :mad::mad::mad:
