Hello Group:

I have over the past week and half been putting myself through mental hell! I have never been in trouble in my entire life. I have absolutely NO past criminal history or poor driving history (this includes parking tickets, speeding tickets... NOTHING... A clean record for the entire time I've been driving). I made the absolute poor judgement call of driving and being pulled over and arrested for a DWI (BAC .15). The irony of it all is that I very seldom drink and was out on a rare occasion, with a friend. Honestly, I have no clue what to expect. I have been in a court room once in my life (where I was a witness to my parents divorce), and that's it. --- I met with one lawyer who moreorless, spoke to me as if I'm an alcholic based on the BAC result (.15), and according to his 20+ years of working DUI/DWI cases. I literally left his office in tears. Needless to say, I won't be using him as my lawyer. However, what troubles me is if his belief is such, will in fact a judge hearing my case believe the same as well? This is very troublesome to me, and I'm sitting here wondering and worrying whether I will serve jail time, or if my license will be suspended for a year or more, or if they'll require me to install one of those devices in my car (mind you, I have been researching on the internet the past week and half and have read all that can possibly happen). The arresting officer was really kind to me, and told me that he could tell I was a good person. He even told me he was sorry for all that occurred (and commented to another officer at the precinct how well mannered I was). All this said, I still have no clue what to do. Thus far (based on what I've read), I have set up an appointment for an evaluation that will cost me $160.00 . I have checked locally and will be attending a MADD panel discussion. And will sign up and attend the 6 week education course that an organization has in my area. Plus, I figured I would also attend an AA meeting once a week. I thought if I do all of this before my court date in April, that the judge (or whomever), will see that I have definitely put forth an effort. I certainly have no problems doing any of this (and figure I will be ordered by the court to do more).

All that said, am I on the right track? What am I to expect? There again, being a first offender with a perfect record before this. Again though, it was a BAC .15 and that I believe I wll have the problems with. PLEASE, if there is ANYONE out there who can give any advice, please email me or respond here the forum for myself and for others who may be in the same boat.

Don't know if I've giving all the necessary information for one to help and give advice. Please let me know if any further info is needed!

By the way, I'm 35 and have been driving for over 12 years.

Well first of all you can't let this thing give you a nervous break down. If your record is indeed clean as you have stated, I am sure your State has options such as diversion. I do not know that for sure in your State, but Talk with lawyer to see what your options may be. As I said ...First offence ,usually their are avenues that you can take .Your lawyer needs to get with the D.A.'s Office and possibly make a deal. You need to try and chill Life is not over....You are lucky that all you received was a DUII, You could have been in an accident. I mean quite frankly .15 is to put it bluntly DRUNK . I'm from MD and was in your situation two years ago. I immediately hired a lawyer. Keep in mind your MVA hearing is independent of your court hearing and your lawyer should represent you in both hearings. The MVA gave me restricted driving privileges for 90 days which meant i could only drive to and from work. It was over in no time and i had my full license back after 3 months but the incident will stay on my record for some time (I’m not exactly sure how long). In court, the judge gave me probation before judgment (PBJ) with supervised probation for one year and 48 hours of community service. PBJ meant that if for that one year if I didn't incur any other traffic violation (DWI, speeding tickets, accidents, etc.), then I would not be convicted of the DWI. Supervised probation meant I had meet with a probation officer once a month and take a breath test. Fortunately I was clean for the year and was released 6 months early of supervision. The community service was an awesome experience I'm so glad I had and will never forget. I worked at the local humane society which was hard physical work but I'm an animal lover so it was very rewarding knowing that I was helping and taking care of the animals.

My advice to you is to do what ever you can to prove to the MVA and judge that this was a terrible mistake you will never make again. Provide them with examples of how you are taking this seriously and you recognize you’re responsible to the community. Start community service, go to AA or some type of recovery group even if you don't think your an alcoholic, get involved with MADD or SADD, read a book on alcoholism and write a report on how it impacted you, etc. Be as proactive as possible and educate yourself on alcoholism and the DWI process. Also get a lawyer and enroll in alcohol education classes even if you don't think you’re an alcoholic. The MVA will require this of you so you might as well get it over with ASAP. The lawyer you saw probably figured you were an alcoholic because you attempted to drive when your BAC was almost twice the legal limit. Most people wouldn't attempt to drive.

Since it’s your first offense, I doubt the MVA will require you to install an ignition interlock device but if you do, it will make you look like your taking the incident seriously and acknowledge your responsibility to the community. It is also highly unlikely you will go to jail.

There's no need to drive yourself crazy or be scared to death. I know it’s hard for you right now but you will get through this as painful as it may be and you will move on like I did. Just realize that what you did put yourself and others in danger and commit to never drinking and driving again. If that feels impossible, then you probably have a drinking problem and should seek help. If it doesn't, then you simply made a terrible mistake and commit to never making it again. Try to see the good out of this because there is some. Maybe you need to take some time out for yourself instead of living your life for something/someone else (career, family, partner, friends), maybe you need counseling to overcome unresolved hurt or anger, maybe you'll meet a wonderful friend/partner in the class, maybe you are an alcoholic and this was your wake-up call. Everything happens for a reason.

I was always curious as to why people are not scared to death to drive drunk but are scared to death to go to court.

**A: because the some people that are scared to death to go to court have actually killed someone to death by driving drunk.

because the "some?" people that are.... school... enroll. you're spending way too much of your life alone in your basement in front of your computer.
 
So I am curious (Flinching) Are you suggesting that people do not kill others when they drive intoxicated? Or do you agree that people should drive while intoxicated? Can you be more explicid? It would just appear that you were not agreeing with the last post.For what it's worth Patrolman/J. Buckner

no, i was just making fun of that guy's lack of intelligence and correct grammar. that's all.

true, true....me too....but this guy does nothing but criticize other people’s posts, rather than giving any advice….over 50 thousand times. i just wanted to make fun of him a little bit, since it's so easy to do.

You're letting yourself get way to freaked out about court. Court is the easiest part of the whole deal.

As stated in earlier posts, since it's your first offense you should qualify for whatever MD version of "diversion" is. You'll likely get a short suspension (90 days) and have to enroll in a state certified alchohol treatment program. These are just processes you have to go through. In my case, the alchohol treatment program and AA have worked miracles for me because I had a drining problem.

Attorneys are going to lump you in the alchoholic category. The DUI system requires that all DUI offenders be considered alchoholics whether they are or not. Afterall, it's your money that pays the salaries and sustains the treament centers.

Relax. You'll be fine. AND......consider my advice. NEVER drink in public or a public place.
