Please help! I was involved in a non-injury accident with property damage to both vehicles. I was cited for DWI and negligent driving. This is my first offense for either. My concern is due to the nature of my job, (Lincoln, NE is my residence), I am worried about not being able to drive. Is there some kind of provisional license that would allow me to drive to and from work? I don't want to lose my job, I am in the medical field and am required to take some call. Also, the arresting officer was new to her job and asked another officer a lot of questions about how to handle the arrest etc. At least 30 minutes elapsed from the time of the accident before she administered a breath test. She told me I barely blew over .11, and said I had to go downtown. She arrested me and cuffed me without advising of my rights. It was at least another 30-45 minutes before a 2nd breath test was done and it was .15. These were the results written on my citation. Is this normal and why wouldn't they use the original results which were closer to the time of the accident? I am meeting with an attorney next week, should I bring up these concerns and can they effect the outcome of my court appearence and sentence? Or am I doomed.
